When studying at a driving school, cadets are faced with such a definition of overtaking as:

Concept difference

To understand how these concepts differ, you need to know that lead is:

  • the movement of a vehicle that has a higher speed than passing vehicles;

  • also, the advance will be considered the case when the car drove into oncoming lane movement, but did not return to the previous one.

The difference between these values ​​is fairly obvious.

That is, when overtaking, the motorist enters the lane along which the oncoming traffic flows, and in case of advance, all maneuvers occur within one part of the road.

Also, distinctive feature of these concepts, there will be the fact that passing cars can overtake both on the right and on the left. But, as a rule, such a ride will be prohibited. On the roads, a prohibition road sign is very often installed, which informs that overtaking or passing on the right is prohibited. As for the advance, there are no special restrictions for it.

When is overtaking prohibited?

But is it always possible to do this legally?

Cases when overtaking is prohibited:

Driving in the opposite lane, ahead of other vehicles, is prohibited on railway crossings, intersections, sharp turns in the road, on slopes, in tunnels.

In addition, there are other places where these actions are prohibited. There are special signs indicating the prohibition, and also, this is a road marking in the form of a double solid line.

These activities are also prohibited pedestrian crossings when people cross the road. The driver will violate traffic rules if he overtakes on the bridge, or the area under it, as well as in areas where there is insufficient visibility.

When the rules don't forbid being ahead?

It is not uncommon for drivers to break the rules and cross the double solid line. In this case, they face the imposition of penalties. In addition, the actions taken may lead to the creation emergency.

Therefore, motorists should know when this maneuver is allowed and how to perform it:

  • The time for the maneuver and the distance to the vehicle ahead in the oncoming lane are correctly calculated.

In this part, we will analyze one of the most dangerous maneuvers “Overtaking”.

Definition:

"Overtaking"- ahead of one or more vehicles associated with the exit to the lane (side of the carriageway) intended for oncoming traffic, and subsequent return to the previously occupied lane (side of the carriageway).

Rules for overtaking, advancing, oncoming passing:

11.1. Before overtaking, the driver must make sure that the lane he is going to enter is free at a distance sufficient for overtaking and that in the process of overtaking he will not endanger traffic and interfere with other road users.

11.2. The driver is prohibited from overtaking if:

  • the vehicle moving ahead overtakes or avoids an obstacle;
  • a vehicle ahead in the same lane has signaled a left turn;
  • the vehicle following it has started to overtake;
  • upon completion of overtaking, he will not be able to return to the previously occupied lane without endangering traffic and interfering with the vehicle being overtaken.

11.3. The driver of the vehicle being overtaken is prohibited from preventing overtaking by increasing the speed of movement or by other actions.

11.4. Overtaking prohibited:

  • on regulated intersections, as well as on unregulated intersections when driving on a road that is not the main one;
  • at pedestrian crossings if there are pedestrians on them;
  • at railway crossings and closer than 100 meters in front of them;
  • on bridges, overpasses, overpasses and under them, as well as in tunnels;
  • at the end of a climb, on dangerous curves and on other sections with limited visibility.

11.5. The advance of vehicles when passing pedestrian crossings is carried out taking into account the requirements of clause 14.2 of the Rules.

11.6. If, outside built-up areas, overtaking or advancing a slow-moving vehicle, a vehicle carrying bulky cargo, or a vehicle moving at a speed not exceeding 30 km / h, are difficult, the driver of such a vehicle must take as much to the right as possible, and if necessary, stop to let the vehicles following him pass.

11.7. If the oncoming traffic is difficult, the driver on whose side there is an obstacle must give way. If there is an obstacle on the slopes marked with signs 1.13 and 1.14, the driver of the vehicle moving downhill must give way.

Road signs:

3.20 “Overtaking prohibited”.

It is forbidden to overtake all vehicles, except for slow-moving vehicles, horse-drawn carts, mopeds and two-wheeled motorcycles without a stroller.

3.21 “End of no-overtaking zone”.

3.22 “Overtaking by trucks is prohibited”.

3.23 “End of no overtaking zone for trucks”.

The zone of action of signs 3.16, 3.20, 3.22, 3.24, 3.26-3.30 extends from the place where the sign is installed to the nearest intersection behind it, and in settlements in the absence of an intersection - to the end locality. The action of the signs is not interrupted at the places of exit from the territories adjacent to the road and at the places of intersection (adjacency) with field, forest and other secondary roads, in front of which the corresponding signs are not installed.

The area of ​​effect of signs can be reduced:
for signs 3.20, 3.22, 3.24 by installing signs 3.21, 3.23, 3.25 at the end of their coverage zone, respectively, or by using plate 8.2.1. Sign 3.24 coverage area can be reduced by setting sign 3.24 with a different maximum speed;

In this case, there is no road markings, but nevertheless, in accordance with clause 9.1 of the Rules of the Road, the maneuver was carried out with the exit to the lane intended for oncoming traffic.

  • Situation 18

    This situation deserves a separate discussion.

    Attention! In this situation, there is a violation! And for such a maneuver, you will be deprived of the right to drive for a period of 4 to 6 months under Part 4 of Article 12.15 of the Code of Administrative Offenses of the Russian Federation!

    The scheme is based on the Decree of the Plenum of the Armed Forces of the Russian Federation of October 24, 2006 N 18 (as amended on February 9, 2012), where Supreme Court clarifies judges. Please note that this document has nothing to do with the traffic police or citizens. Moreover, as practice shows, not every judge follows these explanations and it will not be very easy to achieve the truth by referring to this document.

    In particular, this document contains a paragraph that is absolutely ridiculous and contrary to the Rules of the Road:

    Considering that road sign 3.20 means a ban on overtaking for all vehicles, with the exception of slow-moving vehicles, as well as horse-drawn carts, mopeds and two-wheeled motorcycles without a sidecar, overtaking such vehicles in the area of ​​this sign by other vehicles in the absence of other prohibitions established by the traffic rules (for example, paragraph 11.4 of the SDA), does not form the objective side of the composition administrative offense provided for by Part 4 of Article 12.15 of the Code of Administrative Offenses of the Russian Federation.

    It must also be borne in mind that overtaking slow-moving vehicles cannot be qualified under Part 4 of Article 12.15 of the Code of Administrative Offenses of the Russian Federation in cases where:
    in the coverage area of ​​the road sign 3.20 there is a road marking 1.1 or 1.11, since according to paragraph 1 of Appendix No. 2 to the SDA in contradiction the meaning of road signs and horizontal marking lines, the priority is given to the road sign, which the driver must follow;

    In the situation under consideration, there can be no contradiction! Let's look at the definitions of traffic rules:

    Horizontal markings:
    1.1 - shares traffic flows opposite directions and marks the boundaries of traffic lanes in dangerous places on the roads; indicates the boundaries of the carriageway to which entry is prohibited; indicates the boundaries of parking spaces for vehicles;
    Lines 1.1, 1.2.1 and 1.3 must not be crossed.

    3.20 “Overtaking prohibited”. It is forbidden to overtake all vehicles, except for slow-moving vehicles, horse-drawn carts, mopeds and two-wheeled motorcycles without a sidecar.

    As you can see, there is no connection between sign 3.20 and road markings 1.1. They completely regulate different moments organization of traffic and are used for various tasks independent of each other. For crossing markup 1.1 there is an unambiguous prohibition without exceptions. And even more so, this ban cannot cancel a slow-moving vehicle. In other words, overtaking permission does not give the right to cross the 1.1 marking.

    A contradiction is if it is impossible to follow the requirements of the signs and road markings(for example, when the signs indicate one number of lanes, and the markings another.)

    Let's look at the unsigned situation 3.20

    Now a slow-moving vehicle is no different from a conventional vehicle, because. overtaking slow-moving vehicles is possible only in the area of ​​the sign 3.20.

    Thus, according to the logic of the Supreme Court, the installation of the “No Overtaking” sign allows overtaking.

    You can think about stupidity for a long time, about how and why it happened, but let's just note one point “Lines 1.1, 1.2.1 and 1.3 must not be crossed.” and in both cases of this situation overtaking prohibited!

    I propose to touch on the topic of low-speed vehicles a little.

    There is no such term!

    The only place where you can see this phrase is the name of the identification mark of the same name, the description of which is in the document “Basic provisions for the admission of vehicles to operation and obligations officials for road safety”:

    “Low-speed vehicle” - in the form of an equilateral triangle with a red fluorescent coating and with a yellow or red retroreflective border (triangle side length from 350 to 365 mm, border width from 45 to 48 mm) - behind motor vehicles for which the enterprise - installed by the manufacturer maximum speed no more than 30 km/h;

    Following this definition, before overtaking, the driver must be sure that the maximum speed is set by the manufacturer to no more than 30 km / h.

    Even the presence of the identification sign “Slow-speed vehicle” does not guarantee that the vehicle is slow-moving, and vice versa, that if the sign is absent, then the vehicle is not slow-moving.

    Despite the fact that the driver of a slow vehicle is responsible for the installation of markings, and that the Supreme Court recommends judges not to bring to administrative responsibility for the inaction of the owner (owner) of a low-speed vehicle, it is possible to establish that the vehicle is a low-speed vehicle only in accordance with technical specifications set by the factory manufacturer.

    Situation 19

    Another adjustment of the schemes to the text of the Rules of the Road, which has nothing to do with the real situation. It takes a great deal of skill to start and finish overtaking within a two-lane intersection.

    If you do not take into account this absurdity, then in general the schemes are correct. And there are no difficulties in interpretation

    Overtaking violation:

    11.4. Overtaking is prohibited: at regulated intersections, as well as at unregulated intersections when driving on a road that is not the main one;

    In all of the above situations, overtaking was committed in violation of the rules of the road and responsibility for these violations rests under Part 4 of Article 12.15 of the Code of Administrative Offenses of the Russian Federation in the form of deprivation of the right to drive a vehicle for a period of 4 to 6 months or a fine of 5,000 rubles in case of automatic fixation:

    4. Departure in violation of the Rules of the Road to the lane intended for oncoming traffic, or to tram rails in the opposite direction, except for the cases provided for by part 3 of this article, –
    entails deprivation of the right to drive vehicles for a period of four to six months, and in case of fixing an administrative offense by employees working in automatic mode special technical means that have the functions of photo and film shooting, video recording, or means of photo and film shooting, video recording -
    imposition of an administrative fine in the amount of five thousand rubles.

    Situation 20

    In this case, overtaking is not performed, because. there is no exit to the oncoming lane. Violated the rules for the location of the vehicle on the roadway and the requirements of road markings:

    9.9. It is forbidden to move vehicles along dividing lanes and roadsides, sidewalks and footpaths

    Lines 1.1, 1.2.1 and 1.3 must not be crossed.

    Responsibility under Part 1 of Article 12.15 of the Code of Administrative Offenses of the Russian Federation:

    1. Violation of the rules for positioning a vehicle on the carriageway of the road, passing on the opposite side of the road, as well as driving along roadsides or crossing an organized transport or pedestrian convoy or taking a seat in it - shall entail the imposition of an administrative fine in the amount of five hundred roubles.

    The driver of the vehicle being overtaken does not have the right to prevent the vehicle from overtaking if the maneuver has already begun.

    Overtaking can be done on the left if:

    • there are no prohibition signs, markings on the road;
    • vehicles in front show no signs of overtaking;
    • there is enough space in front of the overtaken vehicle for another car to move there;
    • the car is moving along main road, at a controlled intersection;
    • the car moves on the road at such a distance from the car in front, which at least slightly exceeds the minimum for the implementation of the auto overtaking maneuver.

    If the car is moving on a pedestrian crossing, it is necessary to overtake according to next rule: If a vehicle, moving near a pedestrian crossing, stops or slows down, the car following it should also stop or slow down.

    When not to overtake on the left

    On which side is overtaking allowed? The answer to this question is on the left side. However, there are situations and conditions under which it is not possible to overtake on the left the vehicle in front that is a road user.

    In what cases is such overtaking prohibited:

    According to the current traffic rules, it is strictly forbidden to overtake on the left:

    • at an intersection (both regulated and unregulated), in case of movement on a secondary (not main) road;
    • on overpasses and under overpasses;
    • on ISSO-objects;
    • at railway crossings, as well as at a distance of one hundred meters before and after the specified object;
    • in tunnels;
    • in the upper part of the road, if the latter is uneven sections with hills and depressions, or on any other part of the roadway with limited visibility;
    • on flyovers;
    • on a section of the road where the “Overtaking is prohibited” sign is in effect (starting from the road sign and ending with an intersection or exit from a settlement or after a sign canceling overtaking);
    • at pedestrian crossings and in other places that are intended for pedestrians to cross the road (it does not matter if there are people on this pedestrian zone).

    Legislative regulation of issues of overtaking and advancing

    • that it is necessary to make sure that there is a sufficiently large empty section of the road in front of the vehicle in front - paragraph No. 11.1;
    • on the categorical prohibition of overtaking in certain places - paragraph of the rules No. 11.4;

    Prohibition signs, fines and overtaking on the right

    It is not possible to overtake vehicles on the right, as defined in regulations and other official documents in Russia. However, any violation of the rules described above may lead to the withdrawal driving license for a period not exceeding six or twelve months, or to the payment of a fine.

      Article 11 of the Rules of Traffic is devoted to the rules for maneuvering on the carriageway, including overtaking, advancing and oncoming passing, which establishes:

      • the duties of the driver, which must be followed before making any maneuver;
      • situations in the event of which it is forbidden to perform such a maneuver as overtaking;
      • locked for the drivers of the vehicle being overtaken, in particular, the prohibition to increase the speed, create obstacles and other types of obstacles to overtaking vehicles;
      • special zones in which overtaking is prohibited under any conditions, including in the absence of appropriate road signs or markings;
      • rules of conduct for drivers of slow-moving vehicles, namely the need for the driver of this type of transport to take the extreme right position or stop completely so as not to interfere with overtaking (leading).       Places where overtaking is prohibited

      So, overtaking motor vehicles is prohibited in the following situations (article 11.2 of the Traffic Rules):

      • vehicles moving ahead overtake other vehicles or bypass an obstacle (wheel, pit, foreign objects, etc.) located on the carriageway;

      • vehicles moving in front give a left turn signal about the beginning of overtaking, rebuilding or, respectively, a left turn (reversal);

      • The current legislation, namely Article 11.4 of the SDA, provides a list of places during the passage of which it is also prohibited to overtake motor vehicles.

        In the city

        In the settlement, in accordance with the rules, overtaking is prohibited on the following places, regardless of the presence / absence of prohibition signs:

      1. At regulated intersections (an intersection is regulated if a traffic light is installed that determines the direction of permitted traffic or there is a traffic controller). The ban on overtaking is associated with simultaneous and rather dense, especially in large cities, traffic in both directions.
      2. At intersections that are unregulated, subject to traffic on secondary road. A secondary road may be marked with one of the following signs:
