Polymer films of various quality and shades of color in Russia are now the most affordable raw material for creating so-called tinted cars. How much such behavior is justified, everyone decides for himself.

Moreover, last year there were proposals to raise the fine for tinting to 5,000 rubles. The authors of the proposals motivate the change in the rules by the fight against the transport of illegal goods in cars hidden behind the opaque windows of cars.

However, everything is actually not so clear-cut. A number of legislators and experts representing the southern regions of the country, in all seriousness, consider tinting a useful addition to a car. There is an opinion that the bright sun of the Black Sea and the Caucasus makes it more difficult to drive a car than dark windows. In a number of warm foreign countries, it was precisely such arguments that formed the basis for the legislative permission for tinting. In some cases, for example, in California (USA), car window tinting is a mandatory condition for vehicle operation. The authorities considered that the transparent glass caused excessive overheating of the cabin and, as a result, the abuse of air conditioning, which increased fuel consumption. There is no fine for window tinting, but there is a fine for not tinting!

Tint Law 2020

Clause 2.2.4 GOST 5727 - 88:

The light transmission of windshields of vehicles and trams must be at least 75%, other glasses - at least 70%.

Part 3.1 of Article 12.5 of the Administrative Code of the Russian Federation:

“Driving a vehicle on which glass is installed (including those covered with transparent colored films), the light transmission of which does not meet the requirements of the technical regulation on the safety of wheeled vehicles, entails the imposition of an administrative fine in the amount of five hundred rubles. (Part 3.1 was introduced by Federal Law No. 175-FZ of July 23, 2010).

This statement is true for all violations qualified under Article 3.1 12.5 of the Code of Administrative Offenses of the Russian Federation - "Driving a vehicle on which windows are installed (including those covered with transparent color films), the light transmission of which does not meet the requirements of the technical regulation."

However, in some cases, traffic police officers qualify tinted car windows in an alternative way. The tricks of the traffic police are described in the section below.

How to pay a fine for tinting with a 50% discount.

Since January 1, 2016, Russian motorists have received the right to pay some types of traffic fines with a 50% discount. The new tint penalty laws coming through 2020 don't prohibit it either. However, the ability to pay off the fine by paying only half of the original cost has a number of limitations.

A 50% discount on the traffic police fine applies to all traffic fines that do not contradict two conditions

  1. No more than 20 days have passed since the receipt of the decision (letter).
  2. The fine is not included in the list of the most socially dangerous types of fines.

The traffic police fine for tinting provided for in part 3.1 of Article 12.5 is 500 rubles. If this penalty is paid within 20 days from the date of receipt of the resolution or a copy of the resolution, the fine will be halved and amount to 250 rubles.

How to dispute a tint fine

Back in 2017, a lot of regional publications appeared in the press regarding various tricks that the traffic police use to issue a fine for tinting a car or even arrest a driver for darkening the windows.

So, some traffic police officers, if they find a tint film on the windshield and side glass that does not meet the light transmission standards, will seek to draw up a written warning for you, which will indicate the time frame within which the cause of the malfunction must be eliminated. What is toning

Wikipedia tells us that tinting is a change in the light-transmitting, color and reflective properties of car windows. In other words, this is an additional coating applied to the glass of the car, which reduces the light transmission of this glass.

Toning is used for various reasons. Someone in order to make the car's interior less heated in the sun (especially true in the southern regions), someone - to hide the interior from surrounding eyes. But lately, cars have been tinted less often.

The most popular ways to tint car windows today are:

  • silicone tinting;

Let's make a reservation right away, without going into discussions - all these methods do not meet the requirements of the current legislation.

Requirements for car window tinting (permissible percentage of dimming)

According to the requirements established by the technical regulations of the Customs Union "On the safety of wheeled vehicles" (section 4 of Appendix 8):

Clause 4.2. It is not allowed to have additional items or coatings that limit visibility from the driver's seat.

Clause 4.3. The light transmission of the windshield and windows through which forward visibility for the driver is provided must be at least 70%.

In the upper part of the windshield, it is allowed to have a light-shielding strip made in the glass mass, or with the help of a tint film - no more than 140 mm wide. If the tinting is carried out in the body of the glass, the width of the shading strip must correspond to that specified by the vehicle manufacturer. The light transmission of the light protection strip is not standardized.

Clause 4.4. Body-painted and tinted windshields must not distort the correct perception of white, yellow, red, green and blue.

Clause 4.5. It is not allowed to use glass, the coating of which creates a mirror effect.

In other words, in order not to have problems with traffic police officers, tint so that the light transmission of the front and windshields is at least 70%.

If you still decide to tint the “five”, you need to know that, according to part 3.1 of article 12.5 of the Code of Administrative Offenses of the Russian Federation, for driving a car on which glass is installed (including those covered with transparent colored films), the light transmission of which does not meet the requirements of the technical regulation on the safety of wheeled vehicles, threatens administrative fine in the amount of 500 rubles.

Is it possible to leave the tint after paying the fine

Some time ago, the traffic police issued a fine to the car owner and let him go. He continued to drive a tinted car, again received fines, paid again, and so on ad infinitum.

The traffic police decided that a driver who had previously been brought to administrative punishment for driving a car with tinting and did not remove it (that is, did not eliminate the violation) falls under the concept of "failure to comply with the lawful request of a police officer." . And they put into practice written requirements to eliminate the violation with the simultaneous imposition of a fine for tinted windows.

If in the future the driver did not comply with the requirement and did not remove the film, his actions are interpreted in accordance with Article 19.3 of the Code of Administrative Offenses of the Russian Federation. As punishment under this article, the law provides for a fine in the amount of 500 to 1000 rubles or administrative arrest for up to 15 days.

Administrative arrest for car tinting

Is it legal to arrest for tinting? We studied the practice of applying the law and got the result: courts issue administrative arrests against violators who did not remove the tint from the front windows of the car in time.

If we interpret the law literally, we can conclude that administrative arrest cannot be used as a punishment for tinting. And that's why. Article 19.3 of the Code of Administrative Offenses of the Russian Federation states that administrative liability for this offense occurs in case of disobedience to a lawful order or demand of a police officer in connection with the performance of his duties to protect public order. And the offense provided for by Article 12.5 of the Code of Administrative Offenses of the Russian Federation does not apply to actions that encroach on public order and public safety.

But practice is different. We made a request to the traffic police to clarify the situation. We received the following response. When initiating an administrative case under Part 3.1 of Article 12.5 of the Code of Administrative Offenses of the Russian Federation, the presence in the specialized federal records of the traffic police units of information about previously issued demands to stop similar unlawful actions is checked. If such information is available, the issue of initiating an administrative offense case against the driver, provided for by Part 1 of Article 19.3 of the Code of Administrative Offenses of the Russian Federation, is resolved. Otherwise, the offender is issued a demand to stop illegal actions. The response contains a link to a letter from the Prosecutor General's Office of the Russian Federation, which recognizes this procedure as legal.

How do tinted cars in other countries

Despite the fact that our legislators focus on the special public danger of such an administrative violation, in some countries tinted cars are legal.

In the US, tint requirements vary from state to state. For example, in Alabama, the minimum degree of light transmission of the front side windows can be 32%, in Arizona - 33%, New Mexico - 20%. In Australia, the requirements allow up to 35% dimming of the front side windows. In Thailand, even windshield tinting is allowed. In most European countries, the requirements are similar to Russian or close to them.

What will be the fine for tinting in 2018-2019

This issue has long been worked out in the State Duma of the Russian Federation. The deputies are in favor of increasing the fine for this offense to 1.5 thousand rubles, and in case of a repeated violation - up to 5 thousand rubles. In the spring of 2018, a bill increasing the amount of the fine was submitted to the State Duma for consideration by a representative of the profile committee, however, the law has not yet been adopted.

The tougher punishment for tinting from January 1, 2017 is due to an increased number of accidents due to a deterioration in the driver's view. Initially, an artificial reduction in the light transmission of glasses was done to protect the interior trim material from fading, for some types of special-purpose vehicles. Standards for tinting car windows in 2017

To get acquainted with the current rules of visibility of the machine, it is necessary to study the Technical Regulations on the safety of the vehicle. The norms are described in section No. 4. Changes or other adjustments are not planned in the near future. A new law can be adopted only on the basis of an approved draft, which is not yet available.

Standards for tinting car windows:

  • For frontal and side, providing a driver's view. The light transmission coefficient must be at least 0.7. The exception is cars of category M1. For them, the characteristics of the film on the rear windows are not standardized.
  • A sticker of a filter strip on the top of the windshield is allowed. Permissible width - up to 140 mm, its permissible parameters are not specified in the documents.
  • It is forbidden to use a coating with a mirror effect, regardless of its location on the external elements of the car.

It is also prohibited to install any objects or structures on the glass. They obstruct the view. The exception is passenger vehicles of category M1. They are allowed to install curtains or similar light protection elements on the passenger side.

The rear window and side passenger windows can be darkened to full opacity. In this case, the traffic police officer cannot issue a fine.

Penalties for tinting from January 1, 2017

In early autumn 2016, a bill was passed providing for increased fines for non-compliance with tinting rules. Its appearance is due to massive violation and ignorance of the current legislation.

The amount of the fine increased to 1500 rubles. With a subsequent similar violation, it increases to 5000 rubles. If after that no changes were made to the car in accordance with the law - deprivation of a driver's license. But the last item was removed from the project.

It is noteworthy that these changes were not accepted. The answer to the burning question , what is the fine for tinting the front windows - old norms. According to the content of paragraph 3.1 of Article 12.5 of the Code of Administrative Offenses, the following rules for the formation of a penalty apply:

  • the driver is given 10 working days to bring the characteristics of the car in accordance with the Technical Regulations;
  • the amount of subsequent fines for tinting does not change - 500 rubles.

Alas, but such a measure is not enough to ensure the safety of all road users. In fact, after the formation of the protocol, the violator has 10 days during which he can use a vehicle that does not comply with the Technical Regulations without any fear.

Features of the calculation of light transmission and its verification

Is it possible to independently determine the degree of light transmission for all types of car windows? In addition to the classic film sticker, special models with an internal polymer coating, mass painting can be used. The last two are made only in the factory.

You can find out the value of the factory change in light transmission from the technical documentation. To calculate the possibility of using a tinting film, this factor must be taken into account for the coating and glass. Without additional layers, the windshield and side windows transmit about 80% of the light. Those. in fact, you can only reduce this figure by 10%. Therefore, it is recommended to buy and install a film with 90% throughput.

When checking the light transmission of glass, the traffic police must adhere to the following rules:

  • Measurements are made with a taumeter. The device must be sealed, the original certificate is attached to it. Damage to the body, seals or other defects make it impossible to use the device.
  • Humidity during measurements - up to 45%. Exceeding this value will result in inaccurate results. The solution is to transport the car to a dry box.
  • Temperature limits — from -10°С to +35°С.
  • Measurements of humidity and air temperature are carried out by a traffic police officer using appropriate instruments.
  • The minimum number of measurement points on glass is 3.
  • The operation is performed in the presence of witnesses.

Violation of at least one of the above points is the basis for recognizing the issued protocol as invalid. Therefore, during the inspection, it is recommended to conduct video filming to confirm the fact of the violation.

Similar to the case of supposedly introduced changes regarding the transportation of children in cars, the Internet is full of absolutely unreliable information on the topic that the law on tinting car windows has changed since the beginning of the year. Has the fine for tinting changed since January 1, 2017, has it increased, is it true that tinting will be officially allowed in 2017, and penalties will be canceled.

Why the law fights tinting

When we talk about tinting car windows, it is worth mentioning first of all that we are talking only about the windshield of the car and the side windows of the front row of seats. Regarding the rear of the car, you have the right to do anything - tint with any kind of films or completely clog these windows with boards, as long as both side rear-view mirrors are available.

Why is it legal to tint the windows on the front of cars? For a reasonable person, the answer is obvious - the driver is obliged to follow the road and must anticipate dangerous situations in advance and prevent them. Driving in a tinted car at night cannot but impair visibility, the driver is not able to notice a pedestrian in dark clothes in time (which can be difficult to do from a normal car) and other similar dangers. Try jogging at night with sunglasses on and avoid falling through an open hatch. It's about the same.

All this does not need to be explained to a driver who is sane and has at least an average level of intelligence. Unfortunately, not all drivers meet these requirements, so Russian roads are full of various miracles: completely tinted car windows, artificially lowered suspension that disfigures already unsympathetic models, blinding headlights that do not meet the standards, etc. The drivers of such cars seem to themselves incredibly original and stand out from the crowd, in fact, causing only laughter from other road users.

The law, meanwhile, penalizes any design changes that affect safety, no exceptions, and tinting that goes beyond the standards.
