When to change shoes so as not to get a fine. Law "On winter tires" (2015): what should I pay attention to? The expediency of introducing a clause on winter tires into legislative acts

14.07.2019

It will become mandatory from 2015.

This regulation prohibits the use Vehicle in winter (December, January, February), which are not equipped with winter tires. Administrative liability for violation of this requirement is provided for in the amount of a fine of 500 rubles or in the form of a warning, in accordance with Article 12.5 of the Code on administrative offenses.

Also, according to the "Technical Regulations on the Safety of Wheeled Vehicles", the height of the tire tread pattern must be at least:

2.3.2.1. L -0.8 mm;

2.3.2.2. For vehicles of the category* -1.6 mm;

2.3.2.3. For vehicles of the categoryN and O - 1.0 mm;

2.3.2.4. For vehicles of the category* and * - 2.0 mm;

2.3.2.5. For trailers (semi-trailers) - the same as for tractors with which they work.

Category breakdown:

L- motor vehicles;

M- vehicles with at least four wheels and used for the carriage of passengers;

N- vehicles intended for the carriage of goods, having a maximum mass of not more than 3.5 tons

O- trailers (semi-trailers) for cars and trucks, motorcycles, motor scooters and ATVs;

Due to the vastness of the territory Russian Federation and the onset of actual winter in certain areas and regions in different periods, somewhere the actual winter weather sets in earlier than the beginning of the calendar winter, by decision of the regional authorities, the period for prohibiting the operation of vehicles without winter tires can be changed, only upwards.

The traffic police urges motorists to pay attention Special attention for winter tires. In the first days of January of the coming year, employees of the State traffic inspectorate will begin to check whether seasonal tires are installed by car owners or not. And in case of non-compliance with this important rule appropriate administrative penalties will be imposed.

Can winter tires be used all year round?

The state traffic inspectorate also warns that during the New Year holidays it is especially important that winter tires are installed on your car. Indeed, during this period, motorists go especially intensively to their relatives and friends, go out into the countryside or go on trips. But good mood can suddenly be overshadowed by troubles on the road and the cause of such trouble can be tires that have not been changed on time.

A winter road is no place for arrogance. The rapidly changing situation on the road is dangerous, especially in winter. Changes temperature regime, heavy snowfalls, blizzards and ice do not add confidence to drivers.

Be careful and careful winter roads. Follow the rules traffic and do not rush on the winter track.

Nokian develops winter tires with retractable studs

It is especially noticeable how important it is to change summer tires to winter ones, the State traffic inspectorate continues, when drivers who do not change summer tires to winter get into an accident and create traffic jams. Do not follow their example, but follow the letter of the law.

If the ambient temperature changes from minus to plus, a caring car owner immediately has a question about the temporary order of changing tires. Some motorists change tires earlier, while others "change shoes" wheels later. Therefore, many are wondering when to change winter tires to summer tires in 2017? About this in the article.

Technical regulation Customs Union"On the safety of wheeled vehicles" regulates that in the summer, in particular, in June, July, August, the operation of winter tires (studded) is prohibited. If the tires do not have inserted studs, it can also be driven in summer time of the year. At the same time, the law states that you can move on studded tires until the first of June without a shift.

To determine the correct order for changing a winter tire to a summer one, it is necessary to determine the exact date. No one can name her. However, for the middle zone of the Russian Federation there is a date according to which, until this date, all car owners are required to drive on winter tires. Transition time to summer wheels according to the law - March 15th.

It all depends on the individual weather conditions for each region and local laws. If expected sub-zero temperatures and after this number, for the sake of your safety, you should not change tires.

Rules for passenger cars

The main provisions of the law that determine the rules for switching from winter to summer tires for cars are as follows:

  • On January 1, 2015, amendments to the law regarding the term "winter tires" and its detailed meaning came into force. The revised articles refer to the allowable tread depth. However, there is no mention of seasonal tires while driving a vehicle;
  • Penalties for a shift are allowed by law if the regulations of Part 1 of Article 12.5 of the Code of Administrative Offenses of the Russian Federation have been violated. That is, if the current wheels do not comply with the technical regulations, the changes of which are prescribed in the articles. The police inspector may not draw up a protocol, but simply verbally warn;
  • The new technical regulation law. The conditions prescribed in it relate to summer and winter tires. In summer, you can not drive on studded tires from June to August, and in winter on summer tires from December to February. In accordance with the climatic situation of individual regions taken, the shift period may be changed. So far, there is no penalty for such a violation under the latest statutory provisions.

Therefore, the period for changing from winter tires to summer tires is determined individually, depending on the region and climatic conditions.

The procedure for changing tires for trucks

Changes to the timing of changing tires according to the law will affect and trucks. Regional authorities independently determine the period during which only one type of wheel can be used. At the same time, experts argue that deadlock situations cannot be avoided.

For example, in order for a truck driver to cover the distance from Sochi to Murmansk, he must change from one type to another several times. Creation experts legislative norms propose to amend the law, which will determine the exact date of the change of tires.

You should also change the tire of the truck if it is unsuitable for subsequent operation. There is a procedure for determining tire change indicators:

  • Jumpers are visible on the tread;
  • A tool is applied or determined by eye;
  • The depth of the pattern for summer tires must be at least 1.6 mm, for winter - at least 4 mm;
  • The degree of wear on studded tires is determined by the number of studs remaining.

If at least one of the above requirements does not comply with the norms of the law, rubber on trucks need to be changed.

Terms of wheel replacement according to the law

A bill was passed in 2017. Now car owners are required to change their wheels at a strictly allotted time - December 1. But if tires have already been changed before this date, this is not considered a violation of the law. You can move on a winter tread until the first of March. Upon its onset, you can change the vehicle. However, in some regions of Russia it is recommended to change shoes on March 1 or later. By this date, weather conditions become more resistant to changes.

fines

It should be noted that penalties for summer tires not installed. This provision does not exist in federal law. Therefore, rumors that a punishment is due for an untimely shift are refuted.

When it comes to punishment for driving on winter tires in summer period, here, during the development of the project, it was planned to fine up to 2,000 rubles. However, the initiative is not confirmed by the State Duma. According to the Code of Administrative Offenses, you can fine only for non-compliance of the fine technical requirements in law. Size - 500 rubles.

It would seem that a little more than a year has passed since the heated debate about the mandatory application seasonal tires on cars and fines for driving on summer tires in winter. Now many drivers are looking for information about the so-called law on winter tires, in accordance with which amendments are made to the traffic rules.

Although Decree of the Government of the Russian Federation No. 588, amending the Rules of the Road regarding the use of tires from January 1, 2015, was adopted on July 15, 2013 (“ Russian newspaper"- the official website where you can read the text of the amendments introduced by this resolution No. 588).

IMPORTANT:

Many drivers ask a question: there was a rumor that from December 1, 2017, those who did not change summer tires to winter ones will be fined. Is it so?

On this moment should be answered like this:

At the moment in State Duma The Russian Federation is considering a bill on the introduction of administrative fines in the amount of 2 thousand rubles for using car tires out of season. If it is adopted promptly from December 1, 2017, a driver who violates the rules for using seasonal tires may be fined.

But so far there are no grounds for bringing to administrative responsibility those drivers who did not have time to change their tires!

At the same time, I would like to advise car owners to show their experience and prudence: do not wait for a “command from above”, but “change shoes” on time, depending on the climatic conditions of your region.

Read more about the requirements for using tires by season.

We analyze the law on winter tires (which is the decision No. 588 and the technical regulation TR CU 018/2011)

Decree No. 588 itself does not say a word about the need for the mandatory use of seasonal tires. It only changes the conditions for admitting a vehicle to operation (the decree changes Appendix 5.1 to the main provisions for the admission of wheeled vehicles to operation from January 1, 2015).

The main innovation is minimum depth tread for various types tires on different vehicles in the absence of a factory wear indicator. When a wear indicator is provided on the tires, the fact of wear is established by it.

Yes, for cars set minimum tread depth summer tires equal to 1.6 mm.

However, the resolution introduced as the very concept of winter tires(marking "M + S", "M & S", "M S", as well as a pictogram in the form of a three-peak peak with a snowflake in the center), and the minimum tread depth for it is already 4 mm.

For other vehicles, the restrictions look like this:

  • Motorcycles, mopeds, ATVs, etc. (category L) - 0.8 mm;
  • Trucks, with a license maximum weight more than 3.5 tons (categories N2, N3, O3, O4) - 1 mm;
  • Passenger cars (categories M1, N1, O1, O2) - 1.6 mm;
  • Buses (categories M2, M3) - 2 mm.

In addition, the rubber should not be damaged - various side cuts, frayed to the cord or uneven wear. But the requirements for rims– previously, there should not have been cracks, traces of welding, damage, deformation of mounting holes, etc. on the disks.

Extract from the list of malfunctions and conditions under which the operation of vehicles is prohibited (Appendix No. 3 to the SDA of the Russian Federation), taking into account the amendments introduced from January 1, 2015:

5. Wheels and tires

5.1. The remaining depth of the tire tread pattern (in the absence of wear indicators) is no more than:

for vehicles of categories N2, N3, O3, O4 - 1 mm;

for vehicles of categories M1, N1, O1, O2 - 1.6 mm;

for vehicles of categories M2, M3 - 2 mm.

Residual tread depth of winter tires intended for operation on icy or snowy road surfaces, marked with a sign in the form of a mountain peak with three peaks and a snowflake inside it, as well as marked with signs "M + S", "M & S", "M S" ( in the absence of wear indicators), during operation on the specified coating is no more than 4 mm.

Video - whether or not the Spikes sign was canceled, whether it needs to be glued in the fall of 2018:

Note. The designation of the vehicle category in this paragraph is established in accordance with Appendix No. 1 to the technical regulation on the safety of wheeled vehicles, approved by Decree of the Government of the Russian Federation of September 10, 2009 No. 720.

5.2. Tires have external damage (punctures, cuts, ruptures), exposing the cord, as well as delamination of the carcass, delamination of the tread and sidewall.

5.3. There is no mounting bolt (nut) or there are cracks in the disk and wheel rims, there are visible violations of the shape and size of the mounting holes.

5.4. Tires by size or permissible load do not match the vehicle model.

5.5. Tires of various sizes, designs (radial, diagonal, chamber, tubeless), models, with different tread patterns, frost-resistant and non-frost-resistant, new and retreaded, new and with a deep tread pattern are installed on one axle of the vehicle. The vehicle is equipped with studded and non-studded tires.

Tire Mismatch Penalty

The fine is set at 500 rubles (clause 1, article 12.5 of the Code of Administrative Offenses of the Russian Federation).

Excerpt from the Code of Administrative Offenses of the Russian Federation:

“Article 12.5. Driving a vehicle in the presence of malfunctions or conditions under which the operation of vehicles is prohibited, or a vehicle on which the identification mark "Disabled" is illegally installed

1. Driving a vehicle in the presence of malfunctions or conditions under which, in accordance with the Basic Provisions for the Admission of Vehicles to Operation and Responsibilities officials to ensure road safety, the operation of the vehicle is prohibited, with the exception of malfunctions and conditions specified in parts 2 - 7 of this article - entails a warning or the imposition of an administrative a fine of five hundred rubles

It must be understood that this is not a fine for driving in winter on summer tires (or vice versa), but to a greater extent for the discrepancy between the tire tread depth and their standard values (until other amendments are made).

Tire seasonality

But in the document described above there is not a word about the seasonality of the rubber used, unless, of course, the very definition of winter tires is taken into account.

However, the requirements for the use of seasonal tires are really introduced from January 1, 2015 on the basis of the technical regulation of the Customs Union TR CU 018/2011 "On the safety of wheeled vehicles" ().

Excerpt from the regulation:

5.4. Tires with anti-skid studs, if used, must be fitted to all wheels of the vehicle.

5.5. It is forbidden to operate vehicles equipped with tires with anti-skid spikes during the summer period (June, July, August).

It is forbidden to operate vehicles that are not equipped with winter tires that meet the requirements of paragraph 5.6.3 of this annex during the winter period (December, January, February). Winter tires are installed on all wheels of the vehicle.

The terms of the prohibition of operation can be changed upwards by regional authorities government controlled member states of the Customs Union.

5.6. A tire is considered unusable when:

5.6.1. The appearance of one wear indicator (a protrusion along the bottom of the groove of the treadmill, designed to visually determine the degree of wear, the depth of which corresponds to the minimum allowable depth of the tire tread pattern);

5.6.2. The remaining depth of the tire tread pattern (in the absence of wear indicators) is not more than:

for vehicles of categories L - 0.8 mm;

for vehicles of categories N2, N3, O3, O4 - 1.0 mm;

for vehicles of categories M1, N1, O1, O2 - 1.6 mm;

for vehicles of categories M2, M3 - 2.0 mm.

5.6.3. Residual tread depth of winter tires intended for use on icy or snowy road surfaces, marked with a sign in the form of a mountain peak with three peaks and a snowflake inside it (Figure 5.1), as well as marked with the signs "M + S", "M&S", " M S "(in the absence of wear indicators) during operation on the specified coating - no more than 4.0 mm;

This regulation establishes the need to use:

  • During the calendar winter (December-February inclusive) - winter tires;
  • In summer (June-August inclusive) - summer tires;
  • The rest of the time the tires used are not regulated.

Concepts all season tires, in the new regulation is simply not. However, they will be interpreted as summer in summer, and, accordingly, winter in winter.

But there are requirements, but there is no punishment for their non-fulfillment yet. Those. there is no penalty for driving in winter on summer tires (or vice versa) (yet).

What is this all for

Theoretically, legislators care about the safety of users road transport. The point is that, statistically, most traffic accidents associated with low-quality (worn out, out of season, etc.) rubber. Therefore, they are trying to restore order in this area.

However, in the end it turned out to be a rather mild innovation, which practically does not change the situation.

As for destruction pavement studded tires, here the situation is regulated through the rubber manufacturers themselves, where the factor of destruction of the coating by studs is now regulated by standards. That's why the choice of studded or non-studded winter tires is up to the car owner.

Will there be a penalty for driving in winter on summer tires?

Considering that only half-measures have been taken, it should be assumed that in the future the requirements will be tightened. Already, news is coming from the State Duma of the Russian Federation that at the very soon a fine for driving in winter on summer tires in the amount of 2,000 rubles will be introduced. However, this bill is still being discussed and finalized, and when it will come into force is not yet known.

Difficulties in introduction are caused by different climatic zones, as well as the general unpredictability of the weather. It is also possible to introduce restrictions on the actual weather conditions. At the same time, it is not clear how to behave if the path is long, through many climatic zones. Carry an extra set of tires with you?

But while all this is not there, it is pointless to argue. In the meantime, it is important to monitor the condition of the tires themselves, depending on their type.

Is the driver required to use seasonal tires?

Funny (ha-ha!), it would seem, the question! After all, it is well known that the technical regulation of the Customs Union (TR CU 018/2011), which came into force on the territory of the Russian Federation, requires the use of winter tires in the winter period (from December to February), and summer tires in the summer (from June to August).

In addition, there is the possibility of expanding this chronological framework. For example, if more detailed consideration of regional climatic features. (Well, really, how can Murmansk and Krasnodar, for example, be put in the same row? How can one demand the same terms for winter tires for fundamentally different climatic zones).

And here the most natural driver's question arises: "And how will they punish those who ignore this requirement of the technical regulations?". We will answer boldly: “Not yet!”. That is, there is a requirement, but failure to comply with it will not lead to sanctions (for example, a fine). What will happen next, we do not know. Well, for now? As they say, go for a walk!

Another Russian paradox?

Immediately make a reservation: there is nothing paradoxical in this! The practice of the Russian legal field has the following examples:

  • "kenguryatniki" cannot be installed, and there are no fines for this;
  • it is obligatory to stick the “Beginner driver” sign, but there is no responsibility for failure to comply with this requirement;
  • the maximum speed of movement cannot be exceeded, but in reality it is possible by 20 km / h, etc., etc., etc.

Normal legal "collisions" and "gaps".

That is why the inspector's claim about the discrepancy between the "shoes" of your car and the notorious technical regulations can be culturally sent to ... this most paradoxical situation. Namely: the Code of Administrative Offenses of the Russian Federation does not provide for punishment for violation of the norms of an international regulatory legal act - technical regulations.

And that's it! The conversation with the inspector can be completed with the following words: “Allow me, gr. Inspector, keep moving! Be healthy, you have more stars and shoulder straps in two gaps! (the last sentence is optional).

What are we, the drivers, worried about?

And yet the possibility of punishment associated with innovation is present. In the famous "List of faults ...", with which the operation of transport is prohibited, two adjustments were made - one insignificant and the second, on the contrary, important. And both changes affected only the first paragraph 5 of the section "List ...".

A minor change concerns the tread of summer tires. Now residual height The tread varies not by vehicle type - cars, trucks, etc. (as it was before), but by categories - L, M, N, O (in accordance with the notorious technical regulations).

For example, for cars (M1) and trucks with a GVW of not more than 3.5 tons (N1), the residual tread height should be at least 1.6 mm, for "real" trucks (N2, N3) - 1 mm, buses (M2, M3) - 2 mm, motorcycles and others like them (L) - 0.8 mm. As can be seen from the innovations, the form has changed, but not the content of the requirements.

But a significant innovation is the newly introduced requirements for winter tires. If the driver “changed” his car into winter tires with the appropriate marking (an abbreviation for “mud and snow” or an image of a three-peak mountain peak with a snowflake), then minimum height tread must be at least 4 mm. Indeed, there is an option special indicators wear and tear that should not be subject to mechanical damage from exploitation.

In case of violation of the 4 mm residual height of the tread, the driver’s responsibility should come, provided for by the Code of Administrative Offenses of the Russian Federation - a fine of 500 rubles. But there is a big “BUT” here too…

Who will control and punish the violation of the notorious 4 millimeters?

Here is the question! Let's ask it differently: will the traffic police inspector be able to fine the driver if the residual height winter tread tires of his car is less than 4 mm? Of course, he cannot, because the inspector does not have special diagnostic equipment and the corresponding powers.

Only a diagnostic point that has the right to prevent the operation of a vehicle with such a tire malfunction will be able to prevent it. And then - only at the time of the passage of the periodic technical inspection. And who will punish? It turns out, no one? What a paradox!

It is quite possible that the situation will soon change, but at the moment it is the case in this way. And even if this norm is adjusted, then here the driver will have a chance to avoid liability.

The fact is that the insufficient residual height of the tire tread is a malfunction with which it is allowed to drive the vehicle to the place of repair or parking.

Therefore, a driver caught “red-handed” will always be able to fend off the inspector’s threats by going to a tire shop to replace a worn tire. There was a car in the garage, stood for itself, stood ... I decided to go, and the mice ate the tread. Direct road - to the tire service! Nobody took away this right from the driver.

We wanted the best, but it turned out ...

As always, there are more questions than answers: there are innovations, but the mechanism of their work is not spelled out and not regulated. Therefore, alarmed drivers can calmly exhale. But it doesn't seem to be for long.

And now about the serious. Is it worth the risk when driving on summer tires in winter, and on winter summer? Answer this question for yourself. And be careful, prudent and careful! Live in harmony with the road and be healthy!

How best to behave as a motorist

First of all, use common sense, which excludes driving on summer tires in winter and on winter tires in summer. In addition, the tires should not be damaged, as well as the rims.

Disks

Despite the fact that the items about rims have been removed from the regulations, they should not be underestimated. This one, apparently simple design directly affects security.

Cracks are unacceptable (as well as their repair by welding), because. the integrity of the power structure of the part is violated. In case of emergency braking, the disc can simply fall apart with the corresponding consequences.

And the violation of the geometry of the mounting holes leads to uneven tire wear, along with additional vibrations and instability of the tire contact patch with the coating.

Summer tires in winter and winter tires in summer

The need to use seasonal tires is obvious. However, often individual drivers do not listen to common sense. If driving in winter on summer tires is still scary for most drivers (because summer tires simply harden at low temperatures), then driving on winter tires in summer is not.

It would seem that a little more than a year has passed since the heated debate about the mandatory use of seasonal tires on cars and fines for driving on summer tires in winter. Now many drivers are looking for information about the so-called law on winter tires from January 1, 2015, in accordance with which amendments are made to the traffic rules.

Although Decree of the Government of the Russian Federation No. 588, amending the Rules of the Road regarding the use of tires from January 1, 2015, was adopted on July 15, 2013 (Text of amendments).

We are analyzing the law on winter tires from January 1, 2015 (about which Resolution No. 588 and technical regulations TR CU 018/2011)

Decree No. 588 itself does not say a word about the need for the mandatory use of seasonal tires. It only changes the conditions for admitting a vehicle to operation (the decree changes Appendix 5.1 to the main provisions for the admission of wheeled vehicles to operation from January 1, 2015).

The main innovation is the minimum tread depth for different types of tires on different vehicles in the absence of a factory wear indicator. When a wear indicator is provided on the tires, the fact of wear is established by it.

So, for passenger cars, the minimum tread depth of a summer tire is set at 1.6 mm.

  • Motorcycles, mopeds, ATVs, etc. (category L) - 0.8 mm;
  • Trucks with a maximum permitted weight of more than 3.5 tons (categories N2, N3, O3, O4) - 1 mm;
  • Passenger cars (categories M1, N1, O1, O2) - 1.6 mm;
  • Buses (categories M2, M3) - 2 mm.

In addition, the rubber should not have damage - various side cuts, rubbing to the cord or uneven wear. But the requirements for rims are a thing of the past - previously there should not have been cracks, traces of welding, damage, deformation of mounting holes, etc. on the rims.

Tire Mismatch Penalty

The fine is set at 500 rubles (part 1, article 12.5 of the Code of Administrative Offenses).

It must be understood that this is not a fine for driving in winter on summer tires (or vice versa), but for a mismatch in tire tread depth, and even if you drive on winter tires in summer, the tread depth should still be more than 4 mm.

This regulation establishes the need to use:

  • During the calendar winter (December-February inclusive) - winter tires;
  • In summer (June-August inclusive) - summer tires;
  • The rest of the time the tires used are not regulated.

The concept of all-season tires is simply not in the new regulations. However, they will be interpreted as summer in the summer, and, accordingly, winter - in the winter.

But there are requirements, but there is no punishment for their non-fulfillment yet. Those. there is no penalty for driving in winter on summer tires (or vice versa) (yet). And what is most interesting - the need to use seasonal tires is provided only for passenger vehicles.

Also, there is no administrative penalty for the absence of a “Sh” sticker.

In January 2015, a new technical regulation of the Customs Union came into force, in accordance with which restrictions on the minimum allowable tread depth of tires began to operate: for winter - 4 millimeters, for summer - 1.6 millimeters. In December last year, Russian Prime Minister Dmitry Medvedev instructed the government to develop effective measures to prevent traffic jams on highways in winter time and to amend the legislation to oblige drivers to drive on winter studded tires. Consider what fines for studded tires are valid for 2017.

winter tire bill

On January 10, 2013, Vadim Tyulpanov, Chairman of the Committee of the Federation Council on Regulations and Organization of Parliamentary Activities, proposed a bill providing for fines for unspecified winter tires on car wheels in the winter season. The law is expected to go into effect on January 1, 2014.

The document is planned to supplement the Code of Administrative Offenses with a developed article stating that the operation of a vehicle in strictly specified months of the year without winter tires will entail a fine for tires in the amount of 5 thousand rubles. For officials and legal entities the size of the fine is likely to be more significant, which will become known after further development of the bill. His original version was rejected.

The law on winter tires, according to lawmakers, will solve most road problems, prevent many traffic accidents, protecting both drivers and pedestrians on the road. The reason for the search for options for introducing fines for non-studded tires was the appearance of numerous multi-kilometer traffic jams that paralyze the movement of vehicles not only in the city, but also on federal highways Russia. In most cases, the blockage was caused by non-compliance with traffic rules and the absence of winter tires on cars.

The law on changing car tires according to a strictly established schedule is likely to be adopted by winter season 2013-2014 This order was announced by the country's First Deputy Prime Minister Igor Shuvalov to the relevant departments. The issue of the schedule for changing tires from summer to winter and vice versa at the end of February was discussed at a meeting of the government Commission for Road Safety with the participation of the Minister of Telecom and Mass Communications of Russia Nikolai Nikiforov, Minister of Health Veronika Skvortsova, Minister of Transport Maxim Sokolov, Deputy Minister of Internal Affairs Viktor Kiryanov and other representatives of ministries and departments.

According to the press service of the State Traffic Inspectorate, Igor Shuvalov gave an instruction on winter tires with a time limit - a set of measures should be taken already for the winter of 2013-2014, despite the fact that the technical regulation of the Eurasian Economic Commission on winter tires comes into force January 1, 2015 only. The First Deputy Prime Minister recommended to analyze the world experience in the field of winter tires and to resolve the issue of seasonality in the regions.

According to the draft law developed by Vadim Tyulpanov, winter period he suggested counting the time period from December 1 to March 1, but the regions should still be able to voice their own winter limits for rubber. It should be taken into account that such a huge country as Russia crosses several climatic zones, temperature fluctuations in the middle of winter occur in the amplitude from -3С to -40С, in July the spread is also significant - from 0 to +38С. According to the statistics of the Hydrometeorological Center of Russia, weather conditions in any region can change every year. There are deviations from the average annual values up to 15C in the north and up to 30C in the south of Russia.

Experts say that in winter the accident rate on the roads increases by 30-40%, especially if the road is iced, which reduces the adhesion of summer tires to asphalt, and of course, this becomes a serious problem for both the authorities and the traffic police, and the public.

Besides, summer riding tires with studs can be just as dangerous as winter tires without studs. Spikes can simply fly out of the wheel into the vehicle coming behind, such tires wear out more and break asphalt, etc.

Winter tires and regulations of the Customs Union

The requirement for mandatory use of winter tires in relevant weather conditions, including for trucks, is prescribed in the technical regulations of the Customs Union. The tire replacement law is not just an initiative internal organs, This mandatory requirement Regulations of the Customs Union, applied within the framework of the economic (Eurasian) Union "On the safety of vehicles". Russia must accept these obligations from the beginning of 2015.

However, Russian representatives of the road carrier communities (protecting the rights of drivers heavy vehicles) oppose such norms that may lead to financial difficulties and even cause the termination of the activities of a number of transport companies.

Winter tire law - European experience

In many European countries, such as Finland, Sweden, there are laws that require the mandatory presence of winter tires. Absence the right tires driving a car at a specified time of the year in these countries is a gross violation of traffic rules and is punishable by heavy fines and even serious administrative liability.

So, the climate of Finland is similar to the Russian one. Drivers are required to install winter tires in the country from November 1 and not remove them until approximately March 31, or rather: you can switch to summer tires as early as a week after Easter. Outside the designated period, it is possible to operate winter tires in Finland, if necessary - ice has formed, snow has fallen, etc.

In Latvia, a car must be equipped with winter tires from December 1 to March 1, but legislators plan to replace this framework for the period from October to April.

In Estonia, the use of spiked tires is strictly prohibited at all. Only winter tires with the M+S mark can be installed during the three winter months.

In Germany, the law is only being finalized, its previous wording is rather vague - drivers are required to install winter tires with an eye to the situation on the road.

In Norway, the law makes concessions only to foreigners on wheels who are allowed to come to the country by car with any rubber, locals are required to install the appropriate rubber in winter.

An interesting law on winter tires in Switzerland. More precisely, there is no law as such, but in the event of a winter accident due to the fault of the driver in a car with summer tires, he will definitely write additional fine. In addition, in Switzerland you cannot drive on studded tires above 80 km/h outside the city and above 50 km/h in any locality.

The expediency of introducing a clause on winter tires into legislative acts

In March of this year, the Ministry of Internal Affairs instructed relevant institutions and departments, based on a large-scale study in each region, to determine the feasibility of a law on winter and summer tires. It became known that this is being done so that in some regions the change of summer tires to winter tires and vice versa is exclusively advisory.

The Ministry of Internal Affairs understands that winter tires for trucks do not exist - no spikes can withstand such a large weight. And yet, in the plans of lawmakers there is to oblige transport companies special anti-slip chains.

In Russia, they intend to apply a flexible approach to the rationing of winter tires and anti-slip chains. If Scientific research will confirm the importance and vitality of winter tires in a number of regions, the SDA will be supplemented with a new paragraph of the rules specifying the period for using winter tires - from November 1 to April 1.

If in any of the Russian regions officials consider mandatory use winter tires, which will be enshrined in law, the Ministry of Internal Affairs offers violators to issue a symbolic fine of 100 rubles. However, the deputies continue to insist on a more serious punishment - a fine of 1-5 thousand rubles, so that motorists realize the importance of innovation.

Opponents of "obligation" with tires believe that traffic safety can be ensured in other ways. First of all, the quality of the road surface should be improved, work efficiency should be increased. road services performing timely cleaning roadway from snow and ice. Finally, indirect measures can be applied. For example, in the case of an accident due to the fault of a “non-perforated” car, give the right to insurance companies to recover damages from the violator. Or introduce a special clause about winter tires when passing inspection.

In addition, none of the five bills on winter tires prepared in the State Duma and the Federation Council and not yet considered by Parliament stipulate special requirements to the tires themselves. The current legislation also formulates only General requirements To car tires(we are talking about two resolutions: "On the approval of the technical regulations on the safety of wheeled vehicles" and "On the rules of the road"). The most specific parameters of winter tires are prescribed in the Regulations of the Customs Union "On the safety of wheeled vehicles", which clearly lists the characteristics of studded tires.

Winter tires 2015

Previous bills requiring drivers to use seasonal tires have failed and been voted down. However, from January 1, 2015, the technical regulations of the Customs Union will come into force throughout Russia. This document prohibits the operation of vehicles without the use of winter tires during the winter period, from December to February. Winter tires will be banned from use during the summer months, from June to August.

Of course, the climatic conditions in different regions of our country have their own characteristics, and at the level of subjects, the intervals for using winter tires will change.

For the operation of tires out of season, motorists will be fined 2,000 rubles.

But already in 2014, when Russian drivers changed their cars to winter tires, they began to receive fines from the traffic police for the lack of rear window the “Sh” (studded) icon, indicating the use of studded tires by other road users.

These actions of the traffic police extremely outraged human rights activists, since the fine of 500 rubles issued to drivers for this offense is not provided for by the Code of Administrative Offenses, and therefore it is not lawful.

Winter tires 2016-2017

Legislators have amended the Rules of the Road, which now clearly describe the concepts of winter, summer and all season tires, and also regulate their use, however, the bill on winter tires has not yet begun to work in full force, since the Code of Administrative Offenses has not yet included a fine for violating these requirements.

Earlier, State Duma deputies proposed to punish violators with a fine of 10 thousand rubles, since, in their opinion, the amount of the fine should be equated to the cost of a set of tires. However, the bill is still being finalized, and what will final decision regarding the size of the fine - is not yet known.

Thus, for the lack of winter tires, or rather for violation of the requirements for tire tread depth, at the beginning of 2017, the driver still faces a fine of 500 rubles. And how the situation will change in the future - time will tell.

Hello! I bought a car in the summer, it has winter tires on it, but there is not a single metal spike, the inspector said that he would not sign the application until I put summer tires on, then he said about Windshield that until I replace it it will be the same, THEN I went through, the glass crack is not visible inside the car, the inspector relies on some kind of regulation, asking which one he answered, look on the Internet, turned around and left, not hearing me further! There is nothing on the Internet, except that it is written only what documents are needed when registering a car! How is it legal? What regulation is it based on?

I live in the south of the Rostov region and the snow fell only once, in November approximately, and then, according to the forecasts, solid + sy ... The roads are dry even now ... What kind of spikes can we talk about ??? Legislators are standing in Moscow traffic jams (although I doubt they are) and are driving a HUGE COUNTRY into the framework Garden Ring... Let the road builders work not during the day, thereby creating the biggest traffic jams, but at night, as in many countries (if Europe has already begun to be remembered). In a nutshell, what is not the law is food for the tips ...

And there is no snow in Krasnodar, for those fines, why the hell are you laming the way with spikes, it turns out that way. Comrade civil servants, it’s probably enough to come up with laws that contradict each other, it’s probably time to just work, and not come up with laws that rob people that contradict each other and appear in the legislation a little maybe not every day, which even some lawyers do not keep up with, not to mention ordinary people. And on the road of traffic safety, this is probably not the reason for the absence or presence of spikes, but the reason is such as the lack of road services on the road and if they are visible somewhere then the quality of road maintenance in some places reaches zero. I apologize for the mistakes, I wrote in haste. studded tires, I drove on studded tires three times with my brother on a car, here they are giving the illusion of confidence and losing vigilance among drivers and more fools on the road, at least glue the tracks to them.
