The conclusion of the district court was unexpected not only for the car service, but also for the owner of the Cayenne SUV.

After an examination appointed by the court, which confirmed that the breakdown occurred due to the use of used parts in the repair, the court ignored these arguments, the testimony of car service workers (the court indicated that the car service had no written evidence of the car owner’s warning about possible consequences using old parts). “He also referred to the “Rules for the provision of services for the maintenance and repair of motor vehicles”, which allegedly spell out the need for the contractor to refuse to perform work if the client requires the car to be repaired using substandard parts”, - says the website of Rossiyskaya Gazeta.

The result of the vigorous activity of the district court was shocking: 2.2 million rubles were to be recovered from the car service! Despite the fact that repair cost at 49,000 rubles, and the total market price car is 1 million rubles!


The defenders of the car service did not agree with this decision and appealed to the Novosibirsk Regional Court. The Court of Appeal sided with the defendants. Regional pointed out that the first instance unreasonably ignored the testimony of witnesses - employees of a car service, as well as a forensic examination. He also pointed out that neither the Law "On Protection of Consumer Rights" nor the rules for the provision of services contain requirements for a warning about the inadmissibility of using used parts in a mandatory written form. And the car owner was warned orally. This has been established by the court.

Moreover, paragraph 22 of the rules for the provision of services, referred to by the court of first instance, gives the contractor the right, and does not oblige him, to terminate the service contract if the client insists on using low-quality parts.

The appeal overturned the decision of the district court and dismissed the claim of the car owner against the car service.
