Dear colleagues. Today's article is devoted, so to speak, to the "last resort" through which the car passes before leaving the line - the control and technical point (hereinafter - KTP).

The main function of this unit is to check the technical condition of vehicles before release to the line, after returning from the line, as well as checking the quality of technical maintenance.

The list of faults in which the release of cars on the line is prohibited is determined by the annex to the "Basic provisions for the admission of vehicles to operation and the duties of officials to ensure road safety", which, as a rule, follow after the Rules of the road. Verification methods are detailed in GOST R 51709-2001. Both of these documents can be found in the section. Therefore, I will not dwell on these documents in detail.

Next, let's consider what equipment and tools the control and technical point of the enterprise should be equipped with.
First of all, to inspect the chassis, transmission, brake systems and steering, the KTP must be equipped with an inspection ditch, which in turn must be equipped with stationary (lamps on the walls of the ditch) and portable (carrying lamp) lighting. The inspection ditch must be arranged in accordance with the safety requirements imposed on it. In case of impossibility or inexpediency of the device of a viewing ditch, it is allowed to use a flyover or a lift for a similar purpose.

Let's look at what equipment and tools should be used when checking the technical condition:

All measuring instruments must have a certificate of state verification and pass it annually in the authorized bodies. The tool used in the work must comply with safety requirements.

In order not to load you with unnecessary textual information, I want to offer you all types of ongoing control and diagnostic operations that should be carried out upon release to the line, upon returning from the line and after technical maintenance, in the form of ready-to-use technological maps.

1. Release on the line of a vehicle that is not registered in the prescribed manner or has not passed the state technical inspection or technical inspection, -

shall entail the imposition of an administrative fine on officials responsible for the technical condition and operation of vehicles in the amount of fifteen thousand to twenty thousand roubles; for legal entities - fifty thousand roubles.


4. Release on the line of a vehicle with devices installed on it without an appropriate permit for giving special light or sound signals (with the exception of a burglar alarm), as well as with special color schemes of vehicles of operational services illegally applied to its outer surfaces -


shall entail the imposition of an administrative fine on officials responsible for the technical condition and operation of transport vehicles in the amount of twenty thousand roubles; for legal entities - fifty thousand roubles.

Comments to Art. 12.31 Administrative Code of the Russian Federation


1. The objects of the offense under consideration are public relations in the field of ensuring road safety.

2. In accordance with Art. 20 of the Federal Law of December 10, 1995 N 196-FZ "On Road Safety" (as amended and supplemented), officials responsible for the technical condition and operation of vehicles are required to ensure compliance technical condition vehicles to the requirements of road safety and not to allow vehicles to operate if they have malfunctions that threaten road safety.

3. 5. On the objective side, the administrative offense provided for in part 2 of this article is expressed in the failure to comply with the requirements of paragraph 12 of the Basic Provisions, which prohibit the release of vehicles on the line that have malfunctions with which operation is prohibited, or converted without an appropriate permit. The Basic Provisions for the admission of vehicles to operation and the duties of officials to ensure road safety determine the requirements that a vehicle allowed for operation must meet (see also the List of malfunctions and conditions under which the operation of vehicles is prohibited, which is an appendix to the Basic Provisions ). Re-equipment of vehicles and their equipment can only be carried out with the permission of the traffic police.

6. From the objective side, the administrative offense provided for in part 3 of this article consists in failure to comply officials responsible for the technical condition and operation of vehicles, the provisions of clause 7.15 or clauses 3.1, 3.6 of the List of malfunctions and conditions under which the operation of vehicles is prohibited.

7. From the objective side, the administrative offense provided for in part 4 of the commented article is expressed in violation of the requirements of paragraph 11 of the Basic Provisions prohibiting the operation of vehicles equipped without an appropriate permit flashing beacons and/or special sound signals, as well as with special color schemes applied to the outer surfaces (see commentary to article 12.4).

8. The subjects of the administrative offense under consideration are officials responsible for the technical condition and operation of vehicles.

9. From the subjective side, the offenses provided for in this article are characterized by an intentional form of guilt.

10. Cases of administrative offenses provided for in this article are considered by the head of the traffic police, his deputy, the commander of the regiment (battalion, company) of the road patrol service, his deputy, and for parts 1 and 2 also by state traffic safety inspectors ( article 23.3).

Protocols on these offenses are drawn up by officials of the internal affairs bodies (police) (part 1 of article 28.3).
