When and at what time to turn on the low and high beams, fog lights and daytime running lights? Some motorists forget to turn on the dipped beam during daylight hours. What is the penalty for this offense

Many motorists did not approve of the introduction binding rule about turning on the light daytime days, they think this is a waste of car energy. But this is done to improve road safety, because a car with the lights on attracts much more attention than without it.

Let's figure out what lighting should be like in the daytime, in what cases the inspector has the right to stop you, draw up a protocol on how to avoid a fine.

○ Rules for the use of dipped beam.

In 2010, amendments were made to the SDA, obliging drivers to turn on the lighting during the day when driving. Clause 19.5 of the SDA:

  • “19.5. During daylight hours, all moving vehicles must have dipped-beam headlamps or daytime running lamps switched on to identify them.

That is, now, regardless of the time of day, the car should be illuminated. So, what lighting elements should be included in the daytime? SDA gives three answers:

  • Low beam headlights.
  • Daytime running lights installed in accordance with GOST.
  • Fog lights.

Any of them is enough for the rules to be observed. Dimensions will not fit, as they give enough bright lighting. Far from every car, and especially on older models, daytime running lights are installed. Therefore, those who wish can retrofit a car for them on their own or in service center, subject to obtaining permission from the traffic police and complying with the requirements of GOST, by setting:

  • In front of the car.
  • Not lower than 25 cm from the ground and not higher than 1.5 meters.
  • At least 60 cm between lights.
  • No more than 40 cm from the edge of the car body.

Despite the apparent cost, such retrofitting will save time and money in the future. They load the car's power system less, which is especially important for older models. The driver can choose which lamps to equip the lights with: halogen, incandescent or LED. The latter is the most popular option among car owners.

○ Penalty for driving without dipped beam and daytime running lights.

Let's start with the fact that the driver who turned on two serviceable headlights or running lights before the start of the movement will not receive a fine. In other cases, the inspector has the right to make a decision under Art. 12.20 Administrative Code with a fine of 500r:

  • “Violation of the rules for using external lighting devices, sound signals, alarm or sign emergency stop- entails a warning or the imposition of an administrative fine in the amount of five hundred roubles.

This article will be applied if the driver simply forgot to turn on the daytime running lights, as well as for not turning on the dipped beam in dark time days, regardless of running lights.

The fine does not seem significant, and therefore motorists often ignore this rule. It does not take into account that in the case car accident driver a car that violates the rules for using lighting devices can be found guilty on an equal footing with the second participant in the accident, even if otherwise the collision was not his fault. Then you will have to try for a long time to appeal the decision of the traffic police and receive compensation from the insurance, and therefore you should not violate this seemingly unimportant requirement.

○ Penalty for a non-working headlight.

You can often see a "one-eyed" car on the road. Of course, we are talking about a car with one broken headlight. P 3.3 of the List of malfunctions and conditions under which operation is prohibited:

  • “They do not work in the set mode or the external lighting fixtures and reflectors.

IN this case the driver does not violate the rules for the operation of lighting devices, and therefore he faces only a fine in 500 r. or verbal warning under Art. 12.5 of the Code of Administrative Offenses:

  • "1. Driving a vehicle in the presence of malfunctions or conditions under which, in accordance with the Basic Provisions for the Admission of Vehicles for Operation and Responsibilities officials road safety operation vehicle is prohibited, with the exception of malfunctions and conditions specified in parts 2-7 of this article - entails a warning or the imposition of an administrative fine in the amount of five hundred roubles.

In addition, with such lighting, you cannot move around in the dark on poorly lit streets.

In the early spring of this year, the media began to actively discuss the information that from April 1, drivers can drive without dipped beam in the daytime.

So, new traffic rules come into force, which will be valid until September 30 this year. Here we need to find out whether new information is true.

It is worth recalling that earlier for driving without dipped beam in the daytime, a fine of five hundred rubles could be issued. These rules have been in effect for eight years, and have never been changed.

It is noted that the new rules were introduced in order to prevent traffic traffic accidents. It is the car with the headlights on that is much more noticeable than the one that moves without light.

Many Russians believe that it is stupid to move around with daylight, but only those who do not understand the specifics of big cities think so. It is very difficult to see the car in the rearview mirror under overpasses and in tunnels, especially if their lights are off.

Is it possible to drive without light during the day from April 1: the dipped beam will help to avoid an accident on the roads

In addition, in bright weather on city roads, asphalt gives off glare and blinds drivers, so they may not see other motorists in the mirrors. Bright low beam lights that cut through glare improve visibility and safety. Therefore, using low beams during the day is an excellent method against small accidents.

At present, the old rules continue to apply, no one has made any amendments or changes regarding lighting devices. However, one point is hidden in the rules of the road, around which conversations began.

The fact is that the last amendments to paragraph 19.5 of the SDA were approved in 2010. They significantly tightened the rules for the use of lighting devices on vehicles. If earlier cars it was prescribed to drive during the day with fire only outside the city, then in the new version of the traffic rules it became mandatory inside settlements. Meanwhile, 8 years ago, there was some relaxation.

It was allowed to use daytime running lights instead of low beam headlights. Literally edited clause 19.5 of the SDA read: “During daylight, all moving vehicles must turn on dipped beam headlights or daytime running lights to indicate them.”

On international circuits you can often see when dirty cars blend visually with pavement, so they are invisible at a distance of two hundred meters, although overtaking requires a larger distance, informs the site. As a result, dirty invisible cars on oncoming lane appear out of nowhere, right in front of the nose of the driver who is overtaking.

Is it possible to drive without light during the day from April 1, latest news in Russia: legislation has not been changed in eight years

However, modern running lights should not be confused with primitive dimensions. These are different things. Running lights specially designed for driving during the day, and the dimensions are used only to illuminate the car in the parking lot at the curb.

The confusion in concepts appeared eight years ago, when automotive manufacturers introduced new design farce with increased options. In one block fit dimensions, dipped beam, high and fog lights. In order to mark the cars during daylight hours, experts introduced additional LED sections with special lamps. The brightness is in no way inferior to conventional halogen lights, and their appearance has confused motorists in terms.

Many motorists began to confuse concepts and began to consider themselves the owners of vehicles with running lights. If so, then the low beam is not needed. Here you need to remember that new blocks with running lights are installed so far only on expensive cars, on Moskvich this will not happen.

So, most Russian drivers are still prohibited from driving during the day without dipped beam, both in the city and outside it. None parking lights they can't change anything. The fine for violating the rules is five hundred rubles.

Some motorists forget to turn on the dipped beam when they start driving. It also happens that both headlights are damaged due to an accident or faulty wiring. Driving on city roads and highways with the headlights off is prohibited!

For driving with the low beam turned off, an official warning made by a traffic police officer or a monetary penalty is provided 500 rubles (Code of Administrative Offenses of the Russian Federation - Article 12.20).

If traffic inspectors notice automobile without headlights on,daytime running lights or fog lights, such a vehicle will definitely be stopped. Is it possible to drive on fog lights without dipped beam.

Fog lamps may be used instead of dipped beam headlights in accordance with paragraph 19.5 of the SDA, i.e., including during daylight hours on all moving vehicles in order to identify them.

Stop will happen and in the event that the dipped beam was turned on in the visibility zone of the car by the traffic police.

To avoid imposing an administrative fine on the driver, should Always check low beam headlights And fog lightsbefore driving.

Exist traffic rules to daytime running lights, according to which it is required to check the functionality before each start of movement.

Riding with only side lights prohibited! Allowed movement with included dimensions together with other lighting(dipped headlights, running lights, foglights).

Driving with one faulty light fixture

One dipped beam lamp (headlight) does not burn or burnt out, will a fine be imposed in this case? There are times when a car one headlight bulb burned out, one fog light bulb or one daytime running light. If a traffic police inspector stops a person driving a car and imputes to him, there are several options for the development of the situation.

In the rules of the road ( point 2, part 3.1) there are explanations for such situations, but it is so contradictory that it can be interpreted in both directions (the driver and the inspector).

  1. On-site replacement. If the malfunction can be fixed within five minutes after stop, traffic police inspector not entitled to fine. It should be noted that if one bulb in the fog lamps has burned out or one lamp in the daytime running lights has burned out, the dipped beam can be turned on. Thus, the malfunction will also be eliminated and the car owner will be able to freely continue driving without imposing a fine;
  2. Driving to the place of troubleshooting. Correctly explaining traffic police inspector cause of movement with one lamp off can avoid punishment. If the light bulb burned out while driving and cannot be replaced on the spot, the person it is possible to drive the vehicle to the place of repair;
  3. Drawing up a protocol and imposing a fine.If the inspector starts to draw up a report, and the person driving the car does not agree with the traffic violations , he does not have to sign the protocol. After all documents and papers are handed over to the driver, within 10 calendar days necessary appeal the protocol at the local traffic police.

It is forbidden to move with non-working dipped-beam headlights in the dark and in dark places, with one burning headlight during daylight hours - allowed until the place of troubleshooting.

At night, drive a car with one inoperative headlight, fog lamp or one daytime running light Can only taking precautions while driving.

Attention should also be paid to clause 3.3 in the list of malfunctions in which the movement of the car is prohibited. It refers to the prohibition of the movement of the car with the car lighting devices not working in the established mode. This item is also regulated Article 12.20 of the Code of Administrative Offenses.

Lack of light is a penalty

What is the penalty for not turning on the headlights (driving without) low beam during the day? Regardless of what violation the traffic police officer imputes to the motorist, he can make written warning or issue protocol.

When taken out by an inspector written warning, administrative punishment for the vehicle owner not provided.

If the inspector is protocol offenses, the driver will have to pay an administrative penalty 500 rubles. The appeal is made within 10 calendar days through submitting an application to the traffic police.

In the case where the inspector refers to the list of faults ( clause 3.3), the motorist is threatened written warning about violation or monetary punishment - 500 rubles. There is also a penalty for high beam in the city, it must be switched in accordance with traffic rules.

Punishment for long-range lighting in the city

Using distant lighting within the city limits with proper lighting roadway forbidden(19.1 SDA). If the vehicle was stopped on an illuminated city road while the vehicle was moving with the high beam headlights, an administrative fine will be imposed on the owner 500 rubles By 12.20 Administrative Code Russia.

Penalty for driving with one low beam headlight

What is the penalty if one low beam headlight is not on? The penalty for driving with one dipped beam headlamp, fog lamp or daytime running light inoperative is the same as driving with the lights off - official warning / fine 500 rubles (12.5.1 Administrative Code). At elimination of a malfunction during a stop, no penalty is provided.

Evidence of wrongdoing

According to the laws Russian Federation traffic police officers must prove their case. A person is not required to prove his innocence (until proven guilty, a person is considered not guilty) - Presumption of innocence Article 1.5 of the Code of Administrative Offenses.

Traffic police officers must provide visual evidence. Such evidence is photography, video filming, witness's testimonies.

If there are no such materials, all irremovable doubts must be interpreted in favor of the person driving the vehicle. As practice shows, traffic police inspectors often violate the law when drawing up a protocol, misleading the driver.

It is also not uncommon for an inspector vaguely explain the situation to witnesses And asks to sign the protocol as a witness.

The judicial practice of the Russian Federation shows that in most cases judges take the side of the traffic police officers (there is no reason not to believe the words of the inspector) and do not take into account or ignore the evidence base by the person driving the vehicle testimonials, photography, video).

Punishment for driving with the dipped beam off or one dipped beam headlamp, fog lamp or daytime running lamp not working normally imposed if the car owner cannot fix the problem on the spot. In order not to prove to the traffic police officers and justices of the peace that they are right, before each start of movement, check the serviceability of the entire lighting system car. If a person does not agree with the accusations of the instructor, you need to directly write about it in the protocol.

Instruction

Daytime running lights are not made on all cars. Their purpose is good visibility this car for other drivers and pedestrians. DRLs designate the car at the front, there are none at the rear. For the convenience of the motorist, daytime running lights are turned on together with the engine plant, rarely when it is necessary to do this on purpose. Accordingly, DRLs work on the car always while it is moving.

If your car does not have DRL, then you will need dipped headlights to indicate it when driving on any roads at any time of the day.

Be sure to turn on this light in the tunnel, even if it is daytime or there is lighting in the tunnel. This rule introduced in the event of a sudden power outage. If the car in such a situation does not turn on the dipped headlights, then this can lead to an accident. An accident can happen in those seconds that the driver needs to turn on the low beam, while his car will move in absolute darkness.

If it is raining, snowing or foggy on the road, that is, visibility is far from ideal, dipped headlights are also needed.

When you drive at night outside the city or village, you need high beam headlights. In the city, this light is rarely used: the streets and many other traffic participants who can be blinded by high beams.

You should always switch the high beam to the low beam if it is towards you. The distance to it should be at least 150 meters. Even if the oncoming vehicle is more than 150 meters away from you, and its driver shows that you are blinding it (quickly switching high and low beams), you must turn off the high beams.
It is worth switching from high beam to low beam when approaching the top of the hill, in order to also eliminate blinding oncoming and passing cars. Under these conditions, the driver will not see them in advance, as the view is blocked by the slide.

The traffic rules do not indicate at what distance to a passing car you must turn off the high beam headlights. But it says you must not dazzle other drivers. So if you catch up with the car in front, turn off your high beam headlights.

Not every car has fog lights. Sometimes the drivers themselves equip their car with them, the rules do not prohibit this. The direct purpose of these headlights is to illuminate the road when it rains or fog falls. If you can't see the road ahead of you very well, you should turn on your fog lights along with your low or high beams.

There are also fog lights that illuminate your car from behind. In no case should such lights be connected to brake lights, since they can only be turned on in fog, rain or snow. With good visibility of the road, turning on such lighting of your car on the road is unnecessary.

If you are traveling to heavy snowstorm or a downpour the best option in such a situation, turn on the fog lights plus low beam. High beam headlights in this situation will blind you yourself: the light will be reflected from the snow or rain and return to your eyes.

It is allowed to turn on only fog lights in order to mark your car while driving. But this is possible only during the day when there is no rain, and in no case in a tunnel.

If you decide to stop on the highway at night, the rules require you to turn on your parking lights on your car. Such lights do not illuminate the road at all, but they will allow other drivers to notice your car in advance. When a vehicle parked on the side of the road is not marked with parking lights, it can easily lead to a serious accident.

To enable overall lights, press the appropriate buttons located on the instrument panel: they are located to the left or right of the steering wheel (the location of these buttons depends on the model of the vehicle). The buttons you are interested in are marked with special graphic symbols, so it is almost impossible to confuse them with other buttons.

If you include overall lights you need for foreign-made cars, then this can be done using a lever: for vehicles with a steering wheel on the right, the lever is also on the right, for left-hand drive cars, the lever is on the left. To enable overall lights, it is enough to turn the tip, which is located at the end of the lever.

You can control the turning on and off of the parking lights by setting on motor vehicle"Automatic switch of marker lights". This device is designed to automatically turn off the parking lights after turning on the ignition. In other words, it protects the battery from being discharged.

From October 1, in Ukraine, when driving outside the city, a different driving mode begins to operate: all vehicles in the daytime must drive with the dipped headlights or daytime running lights on. This regime will last 7 months - until May 1 next year. This requirement has been in force in our country for about two years, and for its non-compliance, violators face a rather large fine. To date, many domestic motorists additionally installed emergency running lights - who as a tuning to improve appearance his " iron horse”, and who, to increase security, so that his car was visible from afar. "FACTS" figured out whether non-factory lights are suitable for meeting the requirements of the Rules of the Road (SDA) and whether it is necessary to legalize the installation of such a device.

The modified driving mode outside the city is provided for in clause 9.8 of the Rules of the Road (SDA new edition entered into force on April 15, 2013). It states that “from October 1 to May 1, daytime running lights must be switched on on all motor vehicles outside settlements, and in the absence of such lights in the vehicle design, dipped headlights.” This requirement applies to all cars moving outside the city during daylight hours.

Since control over traffic safety outside settlements is still within the competence of the State traffic inspectorate, we turned to the department of the agency with a request to comment on the nuances regarding this paragraph of the road alphabet.

As explained to us in the press service of the State traffic inspectorate, first of all, this requirement is dictated by an increase in traffic safety outside the city. The fact is that on highways, the speed of transport often exceeds 100 kilometers per hour, while the included headlights or running lights will allow drivers to see the car on the road in advance and refrain from risky maneuvers. As is known, emergencies on high speeds often end tragically. Turning on the headlights is relevant just in the autumn-spring period of time, when visibility deteriorates due to rain, fog, snowfall or snowstorms. By the way, the rule about driving with lights on during daylight hours has long been in effect in many Western European countries, including Scandinavian ones, and has had a positive effect on traffic safety.

“This norm in Ukraine is valid from October 1 to May 1. During this period, due to the reduction of daylight hours and often bad weather conditions, it becomes necessary to improve the visibility of the car both for other road users and for pedestrians, ”explained Mykola Fasovoy, head of the traffic police department of the Ministry of Internal Affairs of Ukraine.

The press service of the DGAI drew attention: you need to drive with the headlights or running lights on only outside the settlements! In the city they need to be turned off, although in case of bad weather conditions these lighting can also work when driving in populated areas.

Law enforcement officers reminded that for failure to comply with this requirement traffic rules violators faces a fine of 425 hryvnia.

Recently, many cars have appeared on our roads, the owners of which have independently installed daytime running lights (DRLs) - LEDs built into front bumper and even in standard front optics. Is such a non-standard device suitable for fulfilling the requirements of the traffic police?

The press service of the DGAI claims that it is not, because the wording of the SDA clearly states "... daytime running lights must be turned on, and if they are absent in the design of the vehicle, dipped headlights." Since emergency running lights are not structurally provided, they are not suitable for fulfilling this requirement of the Rules.

Nevertheless, the traffic police is not against the use of non-standard DRLs, but insists that their installation is a re-equipment of the car, which must be legalized by obtaining the appropriate permits and certificates of conformity - with the subsequent re-registration of the vehicle and making an entry about the installation of DRLs in the registration certificate. Law enforcement officers explain that it is necessary to legalize such a re-equipment in order to prevent cars with cheap running lights from being used (they do not always correspond to necessary requirements, for example, in terms of brightness LED lamps) or with incorrectly installed lights that can dazzle oncoming drivers.

However, based on the current legislation, it turns out that it is not necessary to register emergency running lights. Article 32 of the Law of Ukraine "On road traffic» declares what is a modification of a vehicle and what modification must be legalized. So, the installation of emergency running lights can be attributed to re-equipment, but since it does not lead to changes in the parameters of the car, it does not need to obtain official approvals from domestic licensing organizations. Thus, emergency running lights do not need to be registered and traffic police officers do not have the right to accuse the driver of violating traffic rules.

To date, clear guidelines for traffic police officers regarding the determination of the staffing of DRLs, therefore, they can only do this “by eye”. I must say that law enforcement officers were loyal to such drivers - if headlights or DRLs are on when driving outside the city, it means that the rules are being followed. Even without them, traffic police officers had someone to fine, because, despite the fact that the requirement to turn on the lights outside the city has been in effect for about two years, many drivers often forget to comply with it ...
