Application for violation of parking. Shooting using a special application will fine violators of traffic rules

Application for violation of parking. Shooting using a special application will fine violators of traffic rules

Every year there are more and more cars on the streets of cities. Both the emergence of new drivers and the accumulation of a common fleet play a role here. Unfortunately, architects and urban planners Soviet era it never even occurred to me that a three-lane road in the city center in fifty years could turn into an “eye of a needle” through which traffic flow will drag with average speed 5-15 km / h, and not fly by, blowing an air wave past passing people. The situation in the yards is even sadder: the majority of residential buildings in the CIS countries were designed according to Soviet standards for parking spaces, that is, on average, this is one parking space for several apartments.

The problem of parking, traffic violations and sidewalk driving is especially acute for large Russian cities. Many drivers behave so aggressively that they not only create problems for pedestrians by parking on the sidewalks or destroying green space in the courtyards of houses, but simply pose a danger to city residents.

Previously, video or photo recording of a violation could not be unambiguous evidence of the driver’s guilt, and bureaucratic procedures for the proceedings upon receipt of materials and statements from a citizen could drag on for much more than two months statutory for trial, term. Now the traffic police proposes to release a special application for popular mobile platforms, photos and videos from which could be sufficient grounds for issuing a fine to the violator.

Some publications that have already written about this initiative cite an inaccurate comparison with the sensational Pokemon GO, others draw analogies with squealing and denunciations of the Soviet era.

The appearance of an application capable of correctly fixing the place of violation is, first of all, a simplification of the bureaucratic procedure and new tool increasing civic responsibility. That is, the notorious “come when they kill”, at least in the case of driving on, for example, sidewalks, will gradually sink into oblivion: the very fact that you can receive a “letter of happiness” for many violators will become a serious deterrent. Up to this point, the traffic police and similar services in the CIS reacted to such events only during raids or after fatal collisions.

The Ministry of Telecom and Mass Communications is already developing the application, and the Ministry of Internal Affairs of the Russian Federation has proposed amendments to the Code of Administrative Offenses in order to legalize the use of received video and photo materials through software without a written application from a citizen.

The old call procedure looked like this:

  • photo and video materials were sent to the traffic police;
  • the person who sent the materials had to fill out an application;
  • come to the inspection;
  • MIA officers collected information, interviewed witnesses and conducted investigations;
  • only after that, measures were taken against the violator.
For everything about everything, the law was given two months from the moment of violation, so law enforcement officers often physically did not have time to meet the allotted time.

Now, as they hope in the Ministry of Internal Affairs, with the help of a new application, vigilance of citizens and amendments to the Code of Administrative Offenses, this whole thing will noticeably accelerate.

The software will be available on the government portal. services and, most likely, will use the real passport data of the citizen who downloaded it. As planned by the Ministry of Internal Affairs, an ordinary user will not be able to somehow edit a photo or video received using software, and geolocation will help determine the exact location of the offense.

The idea is to create an application that will help control public order And compliance with traffic rules did not just happen. In Moscow, the “Moscow Assistant” project is already successfully operating, and in Tatarstan, the “People's Inspector” project. Plus, there is a successful experience of the Ministry of Internal Affairs of the Republic of Belarus. For several years now, the hashtag #interception has been actively used on Twitter with the assistance and authorship of the current press secretary of the Main Department of Internal Affairs of Minsk, Alexander Lastovsky, and a website of the same name has been created, with the help of which a citizen can report an offense. After the appeal, the information is already officially transferred to the control room and, based on practice, it is followed by the reaction of the police. One of the disadvantages of the system is that it is a civil initiative and is not directly connected with the Ministry of Internal Affairs. The project of Russian colleagues is reaching the level of creating an appropriate legislative framework and centralized, official use.

Unfortunately, there are still materials from video recorders left behind, which most often record the most serious traffic violations.

It would seem a commendable initiative that will help increase the overall level of civic responsibility and more effectively deal with inadequate drivers, however, this whole situation has its own back side. The violator, according to the law, will still be able to request the data of the accusing party, that is, the operator, which can lead to a round of violence and reprisals against "overly vigilant" citizens.

Is it possible to call the initiative of the Ministry of Internal Affairs a system of denunciations? More likely no than yes. In EU countries, contacting the police with a report of a violation of the rules traffic or law and order leads to a quick and harsh reaction of the authorities, and the main motivator not to violate the law and order is the safety of one's own funds, since even smoking while driving can result in a considerable fine. Russia, on the other hand, is still in some kind of puberty period of public self-awareness, where lynching, and, as a result, violation of the law, is considered by the majority of society to be a more acceptable development of events than turning to internal organs. It is quite possible that the initiative of the Ministry of Internal Affairs will “break the ice”, and the simplification of the procedure will demonstrate that, first of all, the interested party - society, is able to effectively help maintain order on the streets and without damage to property in the “Stopham” style or assault.

With the advent mobile application to fix traffic violations "People's Inspector" the police will have more work. YouTube videos show how some drivers, having hooked a neighbor’s car in the parking lot, leave, thinking that no one saw them, others - right in front of everyone, turn around through two solid ones, still others - overtake in the oncoming lane, and all of them by and large remain unpunished. But soon this will come to an end.

Many drivers are shocked by the reigning lawlessness on our roads, but they don’t know how to punish violators, or they are afraid to complain. The traffic police advise not to remain indifferent to road boors, but to bring a video recorder and write a statement. The system has not yet been worked out, but the authors of compromising evidence are promised anonymity.

A mobile application for fixing traffic violations allows you to send the footage directly to the traffic police. The smartphone will bind to the place and time, and the video itself will be protected from forgery using cryptography. On the basis of this material, the violator will be prosecuted and possibly punished.

It is clear that you will not fix the speed limit. But lovers of parking on lawns and driving in the opposite lane can be removed. The technology is being tested in Tatarstan. Thousands have already downloaded the mobile application, and the result was not long in coming: for 4 months of last year, 11 thousand violators were identified and punished.

Most of the video complaints came from pedestrians. Of course, it’s easier for them: I saw, approached, took off. But where are the drivers? After all, they are, at times, the main witnesses of egregious violations. Although they can be understood. Imagine, in a matter of seconds you need to get your phone, launch the application and try to shoot something with a trembling hand. As a result, the video, most likely, will not make out anything. But the main thing is to shoot on mobile phone the driver does not have the right, because using gadgets while driving is prohibited.

Experts say it is more logical to entrust video surveillance to registrars. Firstly, there is no shaking, and secondly, from year to year they are getting smarter. Many of them work for operating system Android, under which a mobile application was created for fixing traffic violations, however, not everyone has the ability to access the Internet and a geopositioning system. But it's a matter of time.

That's when personnel with violations will decide everything, provided that there are no problems with the personnel of the traffic police. After all, you will have to watch thousands of videos, and the statute of limitations in such cases is only 2 months. Therefore, the traffic police should be provided with the appropriate staff, since if the traffic police do not cope, many violators will avoid liability on formal grounds.

All the “i” will be dotted with amendments to the Code of Administrative Offenses, they are being developed in parallel with the algorithms of the IT system. And if the logic of work is ironclad, and at least every third DVR is armed with an application, there will be fewer violators. Under the eyes of video cameras, you won’t spoil very much.

Citizens themselves may soon be able to bring to justice violators of traffic rules without the participation of the police. The Ministry of Internal Affairs is developing a special mobile application and preparing amendments to the Code of Administrative Offenses.

Lada on high speed running at a red light. Crashes into a white Volkswagen. Miraculously, there are no casualties. And this is the driver on the "Niva" decided to "slip" to the forbidding traffic light. The taxi driver overtakes the ambulance and stubbornly refuses to let it pass, despite the howling of the siren.

There are millions of videos like this on social media. They are usually filmed with DVR cameras. It is possible to be held liable on the basis of such a record, but it is difficult. You need to send a video to the traffic police, fill out an application, then the violator, if found, will be called to give explanations, an investigation will begin.

The State traffic inspectorate decided to simplify the scheme and create a mobile application with which anyone can record a violation and, by pressing one button, transfer it to the traffic police in a few seconds. special program for smartphones are now being developed with the participation of the Ministry of Telecom and Mass Communications.

"No one will be able to correct the video - this is the main idea. Naturally, if we are ready to make a decision on an administrative offense, the video material must be guaranteed to be protected from any fakes, any adjustments," said Alexei Kozyrev, Deputy Minister of Telecom and Mass Communications.

The traffic police have been talking about the need to more actively involve citizens in fixing violations on the roads for more than a year. Since September last year, the Moscow Assistant mobile application has been launched in the capital to fight parking rudeness.

The "People's Inspector" has been working in Tatarstan for almost two years. The application is the leader in the number of downloads. About 60 thousand residents of the republic have already downloaded it into their smartphones.

“I myself follow the rules, and it’s unpleasant to see people who break them. The program appeared, I joined its ranks,” says Kazan resident Ildar Vafin.

There are restrictions in the amendments to the Administrative Code developed by the Ministry of Internal Affairs - if adopted, they will be valid throughout the country. Videos sent through the application can only be the basis for punishment in cases that "have a direct impact on the state of the accident." This wording is used in the bill. Gross violations included running a red light, driving a oncoming lane, driving on the side of the road. For example, parking wrong place was not included in the list.

Supporters of innovations believe that they will reduce the accident rate and increase the discipline of drivers. Although they note that the system needs to be improved in the future.

“Our main problem now is the lack of inevitability of punishment. When malicious violators know that they can get under camera at any moment and they will automatically receive a fine, then, of course, a certain part of these citizens will behave more adequately,” said State Duma deputy Vyacheslav Lysakov.

Opponents of the new application do not exclude that the heroes of the video will want to take revenge on their authors, and this will lead to an increase in crime. But the Ministry of Internal Affairs and the Ministry of Telecom and Mass Communications retort: mobile inspectors work incognito. The only case when their names can be disclosed is if the offender of the traffic rules appeals against the decision on the fine through the court.

Amendments to the Administrative Code, which relate to video recording on the roads, have not yet been submitted to Parliament. Most likely, this will happen in the fall, and the deputies will consider the bill. State Duma for the seventh convocation.

The traffic police wants to introduce a procedure for fining violators based on a video filmed by volunteers. For this, the department is developing a special application, reports "".

In the administrative code, such a concept as “specialized software used to fix administrative offenses”. This term refers to an application developed by the traffic police that can shoot video with reference to satellite coordinates, date and time, and send it to the inspection. Based on this video, the traffic police will have to issue a fine to the violator. According to the publication, the application is under development.

You can only be punished for certain offenses. Among them are violations “having a direct impact on the state of accidents”. Penalty will be imposed for crossing railway crossing in the wrong place, running a red light, turning left or turning in a prohibited place, as well as failing to give priority to pedestrians and special vehicles and refusing to give way to a car that has the right of way.

According to the State Traffic Safety Inspectorate, this measure will greatly simplify the control of traffic violations, as well as facilitate the procedure for imposing fines, because the administrative procedure currently requires the direct presence of the violator.

Consideration of such appeals entails significant time and resource costs for the employees of the State Traffic Inspectorate for the process of proving the circumstances of the offense, while employees are limited to a two-month period for bringing to responsibility.

from the explanatory note of the Ministry of Internal Affairs to the additions to the Code of Administrative Offenses

In 2013, the traffic police procedure, which makes it possible to prosecute a violator of traffic rules, is based on data from video recorders. As the initiative was justified then, decent drivers were tired of “auto-rudeness”, so it was decided to simplify the punishment procedure.

But, as explained in the inspection, one shooting was not enough. An eyewitness to the violation was required to personally write a statement, and even then the traffic police officer was obliged to find out the identity of the offender and bring him to justice.

In some Russian regions, an application is already operating, with the help of which any citizen can complain about a driver who has violated traffic rules. In September 2015, Moscow's Helper app began operating in Moscow, which makes it possible to detect violators of parking rules. In Tatarstan, the People's Inspector application is used to expose violators. With it, you can also report to the local traffic police about violators on the road.

There are activists who fight against rudeness on the roads and parking lots without any applications. For example, in Stavropol, civil activist Mikhail Alferov has been sending photographs of violators to the traffic police for several years, forcing the inspection to take action. According to him, about 60% of the photo evidence was accepted for consideration, and violators were punished. But, as activist TJ said, the traffic police initiative can run into the intricacies of the law, as is the case with any civil activity.

The success of the traffic police initiative depends on whether, along with the new application for smartphones, changes will be made to the current legislation. Such changes in the law should allow the Ministry of Internal Affairs to use photos and videos obtained using the application as materials on the basis of which the perpetrators will be held accountable without being called to justice. official and without protocol. As it happens with materials obtained in automatic mode with the help of special technical means photo and video recordings available on the balance sheet of the Ministry of Internal Affairs.

Otherwise, the procedure for bringing violators to justice will not change. After all, it is still possible to fine for traffic violations based on photographs or video recordings from conventional cameras. In my personal experience, approximately 60% of applications for traffic violations with the application of photos or videos taken by the camera of the phone, they end up punishing the culprit. The rest of the violators manage to evade responsibility, as a rule, due to the expiration of the statute of limitations for the violation (2 months), during which the traffic police are unable to ensure the appearance of the person against whom the case of an administrative offense is being conducted, or to prove guilt (the photo often shows a vehicle, say, parked in violation, but does not see the person whose guilt should be proven).

As Mikhail said, the key difference between photo and video recordings from civilian devices and materials from special cameras is that administrative proceedings are carried out according to ordinary photographs and records in the usual manner: a protocol is drawn up, the alleged violator is summoned to the department, his guilt is proved.

At the moment, cameras operating in automatic mode on the roads hold only the owner liable. vehicle. In this case, the owner of the car has to prove his innocence: for example, to explain that he was not driving at the time of the violation.

For the rest, any citizen today can record a violation on a smartphone camera, send an appeal through the official website of the traffic police and count with a 60 percent chance that the auto hack will suffer a well-deserved punishment.
