Legislation

According to the law, he must replace the "shoes", because of the condition of the road it is dangerous to do so.

In such cases, regional and local authorities are given the right to increase (but not reduce!) the service life winter wheels and, accordingly, the period of their restriction. That is, the authorities can prohibit the use of spikes from May to September, but not from June to August.

There are reservations in the regulations - which tires are considered winter. It must be marked:

  • "M + S";
  • "M&S";
  • "MS";

But what about the “all-weather”, the rubber that is designed for year-round use? If it has the above markings, it is just right to use it in winter months if not, you can't.

Why are you ready to be punished?

And yet for what and how much can the driver be punished? When amendments to the law on punishment for driving on off-season tires were only being developed, they estimated it at 2,000 rubles, but this amount was not approved, and now the fine is 500 rubles, and the wording will be as follows - for the operation of vehicles that do not meet technical requirements.

In the Rules of the Road and the favorite legislative document of the traffic police - the Code of Administrative Offenses - a direct article on the need to change tires from summer to winter or a ban on summer use There is no "spike". But the Technical Regulations of the Customs Union is a document that establishes the norms international law and cannot be ignored. On a par with Russian laws it is obligatory for implementation on the territory of our country.

Currently, the Code of Administrative Offenses does not contain references to the Technical Regulations, therefore, they cannot punish a driver for the lack of winter tires. So far, there is only a draft of these changes to the law. But there is a punishment for worn out winter tires, since there are legally established norms:

  • summer tire tread height - not less than 1.6 mm;
  • height winter tread(minimum, in the most worn place) - not less than 4 mm.

Although clear provisions in the Code have already been developed, non-compliance with them does not provide for rigid liability.

The disadvantage of the current amendments is the impossibility of introducing the Unified Code of Requirements throughout the country. Therefore, the relevant bill was not finally adopted. In addition, the absence of the “Spikes” sign also does not provide for punishment for the driver.

If you do not comply with the above requirements, then a fine of 500 rubles becomes lawful.

If spikes flew out on studded tires

Let's consider a slightly more complicated situation - when the car has winter tires, but without the remaining spikes - is it possible to drive such a car? Yes. This bill still has a huge number of shortcomings. And the main one is that in the Rules of the Road, in the appendix on the admission to the operation of vehicles, the requirement is prescribed only for the tread depth. They do not talk about the requirements for the seasonal use of tires (summer or studded). Yes, these requirements are spelled out in the regulations of the Customs Union, but they do not appear in the Rules of the Road of the Russian Federation. That is, if the law is passed, there will be nothing to punish.

According to the rules, tires with a tread depth of less than one millimeter cannot be used for cars. In winter, when driving on a snowy or icy road, it is forbidden to use tires with a tread depth of less than 4 mm.

It is really possible now to bring responsibility for this into the Code of Administrative Offenses. However, the ban on spikes in June, July and August, as well as the ban on summer tires in December, January and February, is only registered in technical regulations Customs Union.
