When it is necessary to turn on the dipped headlights. When to turn on low beam headlights

When it is necessary to turn on the dipped headlights. When to turn on low beam headlights

Dipped headlights during the day in Russia can not be turned on from April 1 - is it true or not? In the spring of this year, everyone started talking about what came into effect new law, which cancels the obligation to drive with headlights on in daytime days. But now there is no evidence of its introduction into the course. And only information is distributed through the media and the Internet. If you look at different sources, you can conclude that it came into force on April 1, 2018. True or not, we will now understand in this article.

What happened?

If you read the new amendments to the laws, then there is no longer a need to use headlights daylight . But many were in a misunderstanding, because they thought that there was a certain law, where it was written that turning on the headlights in the daytime was simply necessary to indicate their presence on the road and not get into emergency. And as we already know, many old law continues to operate and a new one has not yet been accepted.

Based on numerous sources, it has different types, namely:

  • Some sources indicated that under the new law, you can not use headlights, only during the daytime and in summer period. Therefore, it starts to act from spring to the end of summer, when the day is longer, and then they just need to be turned on;
  • Many experienced drivers, consider this law not reasonable, because, by virtue of their experience, they understand how unreasonable this statement is, especially the law says that running lights should be turned on, but the low beam is not necessary;
  • You can also read that any lighting fixtures during the day in the summer, you can not turn it on at all.

These are the points spelled out in the new law, and they are considered by many to be wrong and can provoke an accident on the road.

Is it true?

Absolutely crazy statement. After all, to ensure safety on the road, it is simply necessary to use low beams. No laws regarding the refusal to use these devices have been introduced, and are not planned to be introduced now.

What is a formalized change?

Rules traffic- this is an approved act, which is approved exclusively by the Government of Russia, and changes are made by special procedures. Therefore, who does not believe that there have been no changes regarding lighting devices, it is worth considering the procedure entry into force of the law:

  • To begin with, if any changes are planned to be introduced, they must first be discussed;
  • Then, after discussion, they are posted on the site, where you can see all the necessary information about it.

This procedure for the entry into force of any change is based on Presidential Decree No. 763.

Therefore, based on the above information, we can conclude that this law could not be valid in any way, because it was not posted on any website and it was not submitted for discussion, and otherwise the law cannot be adopted and act.

What information is true?

Yes, you can really drive without turning on the lights, but not with us. Two years ago, such a law was issued by the Transnistrian authorities. Indeed, it is allowed to drive there from the period of spring to the end of summer without turning on the headlights. But in Russia, everything remained unchanged.

What information can be seen on the site?

Editions of the rules of the road - this is another argument that no law on driving during the day without turning on the headlights did not come into force. Now all the changes and those that have been introduced for consideration can be viewed on the Consultant Plus website. Here you can find several editions, those laws that have already entered into force and those that are still awaiting decision. But if you go to this site, you can understand that there is not, in any of the sections of the change about the low beam. But the following laws can be found:

  • Reflective vests have become mandatory, they must be available for every driver;
  • Waffle markings appeared at the intersection;
  • Will be regulated environmental class cars.

Therefore, we can conclude that there is no change regarding the cancellation of the dipped beam headlights, therefore it is necessary to turn on the headlights during the day.

How to use lights correctly?

If you carefully read the traffic rules, then it is indicated there. What exactly in this way, it is worth using light devices:

  • Be sure to use these devices at night to ensure safety on the road. When the driver stops at dark road, he definitely needs to include dimensions to ensure safety on the road;
  • If there is bad weather on this day and in order for other drivers to see you, you need to turn on the lights;

During the day, do not turn on the headlights rear light. It is also forbidden to turn on high beams, because you can illuminate other drivers and an accident will occur.

Is there a penalty if these requirements are not met?

Yes, of course, this fact of violation is regulated by law. And if the driver decides not to turn on the headlights, especially in autumn, then he can pay a fine of 500 rubles. These rules and regulations exist in a certain article, and according to it, all drivers will be punished. Who do not comply with the rules of driving with lighting devices.

In this article, you learned that you can turn off the dipped headlights during the day in Russia. If you have any questions and problems that require the participation of lawyers, then you can seek help from the specialists of the information and legal portal "Sherlock".

Regarding the headlights of a car and external lighting devices in general, it has not been introduced in our country for a long time. But more recently, an alleged change in the current traffic rules has appeared - the dipped headlights in the daytime in Russia can now be turned off, at least in summer time. According to various sources, the new law comes into force on April 1, 2018. Is this true, we figured out all the changes in the Rules and other regulations!

What's happened?

In mid-March 2018, the network was flooded with news that allegedly from April 1, another change comes into force, canceling the obligation to turn on headlights during the day in Russia. There are no references to either the initiators of the bill or to the official changers. traffic rules documents. And the news was spread mainly through the Telegram and WhatsApp messengers.

According to the innovation, in our country, from April 1, turn on the headlights in daylight hours- Specifically low beam and even daytime running lights - no obligation. That is, something happened to paragraph 19.5 of the SDA, which reads:

during daylight hours on all moving vehicles in order to identify them low beam headlights or daytime running lights must be switched on.

According to various sources, the new law has the following types:

  • the change extends the permission not to turn on the dipped headlights during the day only in the summer or snowless season - from April 1 to September 30 of each year. The argument is simple: in summer, daylight hours are much longer than in winter, so there is simply no need to use lighting devices;
  • you can not turn on the dipped beam, but daytime running lights are a must - a strange, in fact, statement, because today and without changes in traffic rules, this is prescribed;
  • the included headlights in Russia were generally canceled in the daytime - that is, in any season on any car you can not use external lighting devices (except turn signals of course) during the day.

This is true?

No. It is not true. Low beam headlights or DRLs still need to be turned on during daylight hours. No new laws regarding external lighting devices have been introduced either since April 1, 2018, or ... even as far back as 2014. And changes specifically regarding the light are not planned.

What will you prove?

Everything is very simple. There are 2 possible "proofs".

Official publication of changes

Since the SDA is formally a by-law introduced by a decree of the Government of Russia, then the changes are introduced by the relevant decrees. And to prove that there were no changes regarding lighting devices is easy, knowing how the regulations come into force:

  1. the resolution is introduced for discussion and adopted,
  2. further, the published change must be published on one of the official sites of legal information, and such are regulated by Presidential Decree No. 763 on the procedure for the entry into force of legislative acts.

Paragraph 2 of this Decree tells us the following:

2. Acts of the President Russian Federation and acts of the Government of the Russian Federation within 10 days after the date of their signing are subject to official publication in the "Rossiyskaya Gazeta", the Collection of Legislation of the Russian Federation and on the "Official Internet Portal of Legal Information" ( www.pravo.gov.ru) , the functioning of which is provided by the Federal Security Service of the Russian Federation.

Accordingly, by going to these sites, we will not find any official decisions there on changing the rules for driving during the day without dipped headlights from April 1, 2018:

What is true?

It was allowed to drive during the day without headlights - this is the truth. But not in Russia. The corresponding decree was issued by the authorities of Transnistria, an unrecognized state of the Moldavian Republic... 2 years ago

How this news suddenly spread to the traffic rules of Russia remains only a mystery. But the fact remains - in Pridnestrovie, indeed, from April 1 to September 30, you can not turn on the dipped headlights during the day (about this video), but Russian SDA this part has not changed.

Editions of traffic rules

Another argument against the change in the Rules of the Road is the revision of the SDA. With every change comes into effect new edition. To date, the most up-to-date database on them is contained on the Consultant Plus website. And here you will find 3 editions: one - which entered into force on March 18, 2018, and 2 more - awaiting this.

But most importantly, none of them has section 19 of the SDA in the list of changes, which just concerns lighting devices.

  1. the version that came into force on March 18, introduced mandatory reflective vests ,
  2. second will begin to operate from April 28 and marks the appearance of waffle markings at intersections ,
  3. third- from July 1 and will regulate the environmental class of cars.

As you can see, no changes have been introduced to the traffic rules since April 1, 2018, and you still need to turn on the headlights during the day.

How should lighting devices be used today?

So, traffic rules today regulate following rules use of headlights.

Night time:

  • near and / or rear PTF together with the dimensions when parking on unlit sections of roads (the middle one is not necessary to include, but the dimensions are mandatory),
  • only on unlit roads and only together with near or far.

Insufficient visibility(fog, rain, etc.):

  • near or high beam(see below the conditions when you cannot use the high beam) when driving,

Daylight hours(any of the above):

  • Daytime Running Lights,
  • dipped headlights,

The rear lights do not need to be turned on during the day.

Tunnels:

  • low beam or high beam (see conditions below for not using high beam).

When not to use high beam headlights:

  • on the illuminated road in settlements,
  • closer than 150 meters from the oncoming lane,
  • further than 150 meters from the oncoming lane, if the driver of the oncoming car blinks far,
  • in any cases where you can blind the drivers.

It is not forbidden to directly blind pedestrians with distant traffic rules.

What is the fine if you drive during the day without headlights?

If you drive on February 19, 2019 without any light at all - regardless of whether it is a neighbor, DRL or fog lights, then you are waiting a fine of 500 rubles. This is provided for by the only article in the Code of Administrative Offenses - 12.20, which provides for penalties for any violations of the use of lighting devices - whether it is the lack of light during the day or the failure to turn on the turn signals during maneuvers.

The time to turn on the headlights of a car is not a whim of the driver, but a point clearly stated in the rules of the road. A special section describes all the conditions in which you need to light running lights, high and low beams and fog lights. We will tell you which headlights should be on during the day and what the driver needs to know so that there are no controversial moments on the road.

Points of traffic rules about dipped headlights during the day

Rules of the Road, clause 19.5, tell us that any moving vehicle must identify itself as a BS or day running lights. Paragraph 19.4 allows the use of fog lamps for marking the vehicle.

For violation of these rules, a written warning from a traffic police officer or a fine under one of the two articles of the Code is provided. administrative offenses RF:

  • article 12.20 says that if the driver simply forgot to mark his vehicle with light signals, then he may receive a warning or a fine of 500 rubles;
  • article 12.5 says that the driver must pay the same fine of 500 rubles if one or both headlights are faulty. In this case, the operation of the car is prohibited until the malfunction is eliminated. The same applies to extremely dirty glass and burnt out light bulbs.

There is also a controversial point that many motorists forget or do not take into account.

During the day, the driver uses foglights and enters the tunnel, and at the exit he receives a fine for not included in accordance with the rules SDA headlights. He is stopped by a traffic police officer due to the fact that the driver violated paragraph 19.1 of the traffic rules, which establishes that when entering the tunnel it is necessary to switch from fog lights to dipped beam. The same goes for DHO.

In addition to these rules, the rules of the road allow the use of the BS as a supplement to the position lights (but not instead of them) in conditions insufficient visibility. This is not so important, since such a car poses a danger primarily to passing vehicles.

What headlights need to travel during the day

At the beginning of 2006, all Russian drivers were required to use BS during the daytime when driving outside settlements. Since 10/20/10, this item has been revised, and now every driver is required to turn on the BS or DRL when driving on any highways.

Failure to comply with these rules is punishable by a fine of 500 rubles or a warning, so motorists had no choice but to start complying with it. However, the debate about how effective and relevant this rule has not subsided. Some said that a car marked with light is easier to see in conditions of insufficient visibility (in fog, during heavy rain, twilight and in the forest), while others complained that due to such a rule, fuel consumption would be higher, and bulbs would burn out more often. Let's try to figure this out.

Should it be included low light during the day

In total, BS bulbs, dimensions and car number plate lighting require about 150 watts of power. Diode DRL lamps - approximately 15 watts. For comparison, an air conditioner requires 4500 watts, about 30 times more. Therefore, an economical motorist should first of all refuse air comfortable temperature in the cabin, and not from the included light bulbs. If we translate power into fuel consumption, then BS lamps and the rest of the backlight increase consumption by approximately 100 ml of gasoline per hour.

Why turn on the headlights during the day

It turns out that the motorist loses practically nothing from the included running lights, so it’s worth talking about what he gets, except for the 500 rubles saved on a fine.

There are several situations when a car without headlights is practically invisible, even with DRLs or fog lights on. They are not as rare as they seem.

  1. In the forest, against the background of trees, the car is already lost at a distance of 150-200 meters - this is the perception of the human eye. This effect can be especially noticed in winter, when an even layer of snow covers the trees and the ground - then all objects on a white sheet seem to be noise. Of course, it is rare to see another car in a dense forest, and usually the speed of a vehicle in such an area is low. But still, you should not save 100-300 milliliters of gasoline and neglect safety.
  1. When driving on the highway in cloudy weather, the car is still noticeable at a distance of 200-300 meters, especially if it is alone on the road. But as soon as other cars appear, but with the headlights on, it is lost and almost does not stand out from the background. With an increase in the distance to 700-900 meters, even DRLs will not help to distinguish the car.

In general, the included BS lights help not to get lost in the traffic flow and be seen by other drivers when changing lanes. For pedestrians, however, vehicle detection time is critical due to the difference in speed.

If it still seems like you don't need to turn on your headlights during the day in the city, then here is a study by experts that supports turning on the low beam. On average, the probability of an accident for a driver is reduced by 13 percent. This figure is made up of many others: including, the chances of a pedestrian being reduced by 15%, a cyclist - by 10%, frontal and side collisions - by 10%.

The only thing that turned on the BS is bad is that it is more difficult to notice brake signals in dense stream. This can be avoided by installing an additional brake light on the rear window.

conclusions

Daytime running lights consume a minimum amount of energy and practically do not affect the wealth of the motorist. The situation is approximately the same with low beam headlights - constantly on, they will cost the driver 100 milliliters of gasoline every hour, which is approximately 4 rubles.

But by spending these four rubles for every hour of driving, the driver saves something more significant - meters and seconds, which allow him to make the right decision in time and maneuver safely in the stream. This is especially important for pedestrians and in conditions of insufficient visibility: in cloudy weather, fog, rain or in the forest.

The non-included dipped beam is one of the most common causes stop cars by traffic police officers.
Traffic rules restrict the use of cars with off lights. It does not matter whether such devices are installed on the car at all, whether they are in good condition or not.

A few years ago, significant changes were made to the rules of the road, according to which all drivers of vehicles can only travel with dipped headlights, fog lights or running lights. As the traffic police say, the movement of a car with the lights on makes it more noticeable on the roads and in settlements, regardless of the time of day.

Most drivers do not attach importance to the importance of such a requirement of traffic rules and do not turn on the dipped beam when they start driving their car. In some cases, the lack of dipped beam may be the cause of a malfunction. lighting fixtures or wiring.

The rules of the road clearly state that driving on city roads and highways without dipped beam is on is prohibited. In its absence, the driver is held liable:

  1. In the form of an official warning from a traffic police officer.
  2. In the form of a fine of 500 rubles.

If traffic police officers notice a car on the road without lights on, they have the right to stop it.
Most motorists agree that it is possible to drive with the fog lights on, without turning on the low beam. According to the rules of the road, such headlights can be used instead of low beam during daylight hours, as they also allow you to detect a car and make it more noticeable on the road.

The stop of the car can also be in the case when the switching on of the dipped headlights was made in the visibility zone of the vehicle by the traffic police. In this case, the driver will get off with a warning.

It is the task of the owner of the car to check the serviceability of daylight before each start of movement by car. Ride with parking lights prohibited unless they are included in conjunction with other lighting.

Responsibility for the partial inclusion of dipped headlights

There are cases when a driver drives a car on which one dipped beam headlight or one of the running lights is broken. At the same time, the second headlight is in working condition and turned on.

Despite all the explanations of the person managing vehicle, the traffic police officer who noticed such a car will still issue him a decision on bringing him to administrative responsibility in the form of a fine of 500 rubles. The reason for such a fine will not be a violation of the rules for operating the vehicle, but a violation of the requirements contained in the list of malfunctions.

There are practically no differences between such grounds, however, in such a situation, the driver more possibilities receive not a fine, but a verbal warning.

As a rule, traffic police officers issue a fine for such a violation if the car is moving in conditions of poor visibility or at night.

The traffic police officer can offer the driver the following troubleshooting options:

  1. On-site replacement. If it takes only five minutes to fix the problem, the traffic inspector cannot issue a fine. For example, if a fog lamp burns out in a car, the driver can drive the vehicle with the low beams on. In this case, the malfunction will be eliminated, and the owner of the car will not receive a decision to impose a fine.
  2. If the driver manages to correctly convey to the inspector the reason why one of his headlights does not light up, he can be released to the place of troubleshooting. For example, if the lamp burned out already in the process of driving and the owner of the car does not have a spare lamp to replace it, he can proceed to the place of repair. In such a situation, no penalty is issued.
  3. Drawing up a protocol and bringing the driver to administrative responsibility. If the traffic police officer began to draw up a protocol, but the driver does not agree with it, he may not put his signature on this document. In addition, the driver is entitled for 10 days.

High beam penalty

Can you drive with high beams during the day? Most drivers, especially those who often move outside settlements, do not attach this special significance and always drive their car with high beams on.

Meanwhile, the rules of the road provide for the requirement that driving in locality using distant lighting is prohibited.

If traffic police officers stop a vehicle with high beams on on an illuminated city road, a person driving car, will be brought to administrative responsibility in the form of a fine of 500 rubles.

What can be evidence of a crime?

The principle of the presumption of innocence operates in Russian administrative legislation. In accordance with this principle, traffic police officers must prove that the person stopped by them violated the requirements of the law. The driver does not have to prove his innocence.

To prove that the person driving the vehicle actually committed a punishable act, traffic police officers must present visual evidence:

  1. Photography.
  2. Video filming.
  3. Witness testimony.

If the traffic inspectorate does not have any evidence, all doubts are interpreted in favor of the person driving the car. That is why the driver needs to carefully look at what exactly the policeman writes in the protocol and not put his signature on this document if he has a vision of what happened.
The same applies to witnesses, to whom police officers rarely explain the situation and simply ask them to sign an already completed protocol.

Judicial practice shows that judges always take the side of the traffic police, ignoring evidence from the driver. So it is better to take care in advance to indicate at the time of drawing up the protocol that the situation was described incorrectly.

If the person driving the vehicle does not have any claims against the traffic police, and he does not want to appeal the decision to prosecute, the driver can. This can be done after 10 days from the date of receipt of the decision in any way convenient for the person.
If the driver does not pay the fine within two months, they can be taken against him.

In order not to prove your innocence and not pay fines, it is necessary to check the serviceability of the lighting system of your car before each departure.
