But this contradicts common sense!

Imagine that someone has parked too close in front of you, and it is impossible to go around it, and it is forbidden to reverse even a millimeter.

Well, now what to do?

That is why the Rules allowed reversing and, by the way, nothing has changed in the Rules, no one has canceled paragraph 8.12, and it still allows you to use reverse, including on one-way roads.

That is, the innovation in the Code of Administrative Offenses not only contradicts common sense, it also contradicts the Rules. How could this happen! As you can see it could. And the explanation for such incidents, which has already become a classic in our time, was once given by Viktor Stepanovich Chernomyrdin: “We wanted the best, but it turned out, as always.”

What caused it, this innovation? Drivers began to avoid traffic jams on parallel streets where there were no traffic jams.

And there were no traffic jams because these streets were one-way traffic in the opposite direction to traffic jams.

And how are you supposed to deal with it? Toughen the punishment, which was done. Only, as usual, the legislators did not want to rack their brains over the exact wording of the innovation, they outlined how it happened, and calmed down on that.

But such a contradiction in various regulatory legal acts (NLA) has put not only drivers, but also justices of the peace in a difficult position. For example, here is how the referent of the GUOBDD of the Ministry of Internal Affairs of Russia Dmitry Leibov spoke about the current situation:

“Indeed, driving in reverse on one-way roads has been the topical issue in terms of qualification of such actions of drivers. Unfortunately, there was no consensus on this matter, and it was often possible to encounter the fact that in one district the court deprived the right to manage for such actions, and in the neighboring district it stopped the proceedings. And drivers increasingly took advantage of the existing “loophole” and avoided traffic jams on one-way roads.”

In all likelihood, the “loophole” in this case means paragraph 8.12 of the Rules: “Reversing the vehicle is allowed provided that this maneuver is safe and does not interfere with other road users.”

Relative order was established only after the situation intervened Supreme Court(SC) and issued a special Decree addressed to the judges (so that they judge equally) which literally says the following:

“Violation by the driver of the requirements of any road sign, which entailed the movement of the vehicle controlled by him in the opposite direction on a one-way road, forms the objective side administrative offense, provided for by part 3 of article 12.16 of the Code of Administrative Offenses of the Russian Federation (for example, violation of the requirements of road signs 3.1 “Entry prohibited”, 5.5 “One-way road”, 5.7.1 and 5.7.2 “Entering a one-way road”).

When applying this rule, it should be borne in mind that, based on the content of clause 8.12 of the SDA, reversing on a one-way road is not prohibited, provided that this maneuver is safe for participants traffic and, given the current traffic situation, is caused by an objective necessity (for example, avoiding an obstacle, parking). Violation by the driver of the above conditions forms the objective side of the composition of the administrative offense provided for by Part 3 of Article 12.16 of the Code of Administrative Offenses of the Russian Federation. According to the same norm, it is necessary to qualify the actions of a driver who reversed onto a one-way road in violation of the requirements of road sign 3.1 “Entry is prohibited”, and in the case when such a maneuver was performed at an intersection, also under part 2 of article 12.14 of the Code of Administrative Offenses of the Russian Federation " .

Translated into human language, it says the following:

1. Punish drivers mercilessly for driving from an intersection (whether in reverse or forward) onto a one-way road and moving in the opposite direction.

2. On the one-way road itself, the use of reverse gear is NOT prohibited, provided that it is caused by objective necessity.

It would seem that now the drivers could breathe more freely, although some ambiguity still remained. Yes, you can use reverse when parking and when avoiding obstacles (this is expressly stated in the Decree of the Armed Forces), but here, for example, is it possible to reverse when approaching a passenger, or if the driver skipped the entrance he needed into the yard.
