1. Approve the attached Rules for the organized transportation of a group of children by buses.

2. Establish that the implementation of the powers of the federal executive bodies provided for by this resolution is carried out within the limits established by the Government of the Russian Federation of the maximum number of employees of the federal executive bodies, as well as the budgetary allocations provided by it in the federal budget for leadership and management in the field of established functions.

3. The requirements of paragraph 3 of the Rules approved by this resolution, insofar as they relate to the requirements for the year of manufacture of the bus, do not apply until June 30, 2020.

Rules for the organized transportation of a group of children by buses

1. These Rules define the requirements for the organization and implementation of organized transportation of a group of children, including children with disabilities (hereinafter referred to as a group of children), by buses in urban, suburban or intercity traffic.

2. For the purposes of these Rules:

the concepts "charterer", "charterer" and "chartering agreement" are used in the meanings provided for;

the concept of "official responsible for ensuring road safety" is used in the meaning provided for by the Federal Law "On Road Safety";

the concepts "educational organization", "organization carrying out training" and "organization carrying out educational activities" are used in the meanings provided for by the Federal Law "On Education in the Russian Federation";

the concept of "medical organization" is used in the meaning provided for by the Federal Law "On the Fundamentals of Protecting the Health of Citizens in the Russian Federation";

the concept of "organized transportation of a group of children" is used in the meaning provided for by the Rules of the Road of the Russian Federation, approved by the Decree of the Council of Ministers - the Government of the Russian Federation of October 23, 1993 N 1090 "On the Rules of the Road";

3. For the organized transportation of a group of children, a bus is used, from the year of manufacture of which no more than 10 years have passed, which meets the technical requirements for the transportation of passengers in terms of purpose and design, is allowed to participate in road traffic in the prescribed manner and is equipped in the prescribed manner with a tachograph, and also equipped with GLONASS or GLONASS / GPS satellite navigation equipment and is equipped with seat belts.

In the case of organized transportation of a group of children, when the bus is moving, a yellow or orange beacon must be turned on on its roof or above it.

4. For organized transportation of a group of children, the driver must have the following documents:

a) a copy or original of the charter agreement concluded in accordance with the Federal Law "Charter of Road Transport and Urban Surface Electric Transport" - in the case of organized transportation of a group of children under a charter agreement;

b) the subparagraph became invalid from October 1, 2019 - Decree of the Government of the Russian Federation of September 13, 2019 N 1196 .;

c) a copy of the decision to appoint the escort of buses by a car (cars) of a subdivision of the State Inspectorate for Road Safety of a territorial body of the Ministry of Internal Affairs of the Russian Federation (hereinafter referred to as the subdivision of the State Traffic Inspectorate) or a copy of the notification of the organized transportation of a group of children;

d) a list of a set of food products (dry rations, bottled water) - in the case provided for in paragraph 17 of these Rules;

e) a list(s) of all passengers, including:

children (indicating the last name, first name, patronymic (if any) and age or date of birth of each child, contact phone number of parents (legal representatives), pick-up and (or) drop-off points for each child, if such points are intermediate (not coincide with the point of departure and (or) the destination of the route);

appointed accompanying persons (indicating the last name, first name, patronymic (if any) of each accompanying person, his contact phone number);

medical worker (indicating the last name, first name, patronymic (if any), position) with a copy of his license to carry out medical activities or a copy of the contract with a medical organization or an individual entrepreneur that has the appropriate license - in the case provided for in paragraph 12 of these Rules;

employees and (or) individuals participating in the organized transportation of a group of children (indicating the last name, first name, patronymic (if any) of each employee and individual, his contact phone number, pick-up and (or) disembarkation points for each employee and individual, - if such points are intermediate (do not coincide with the point of departure and (or) destination of the route);

f) a document containing information about the driver (drivers) (indicating the last name, first name, patronymic of the driver, his phone number), except if the documents contain a copy of the notice of organized transportation of a group of children containing such information;

g) a document containing   the procedure for boarding passengers, including children, on a bus (according to documents, including a service certificate, a voucher, a student card and (or) in accordance with the list (s) of passengers certifying their right to travel) & nbsp established by the head or official responsible for ensuring road safety, an educational organization, an organization that provides training, an organization that carries out educational activities, a medical organization or other organization, an individual entrepreneur engaged in organized transportation of a group of children (hereinafter referred to as the organization) , or by the charterer, except for the case  when the specified procedure is contained  in the charter agreement;

h) transportation route indicating:

departure point;

intermediate pick-up (drop-off) points (if any) of children, employees and individuals participating in the organized transportation of a group of children;

point of arrival;

stopping places for eating, short-term rest, night rest (for multi-day trips) - in the case of organized transportation of a group of children in intercity traffic.

4_1. In order to carry out organized transportation of a group of children, the responsible or senior person responsible for the organized transportation of a group of children and coordinating the actions of drivers during multi-day trips must have a list of accommodation places for children for rest at night, containing also the name of the legal entity or surname, name and patronymic (if availability) of an individual entrepreneur placing children on vacation at night or carrying out activities in the field of providing hotel services, or the registration number of the tour operator organizing the transportation in the unified federal register of tour operators.

5. The originals of the documents specified in paragraph 4 of these Rules are kept by the organization or the charterer and the charterer (if such transportation was carried out under a charter agreement) for 3 years after each organized transportation of a group of children, during which a traffic accident occurred with victims, in other cases - within 90 days.

8. Drivers meeting the following requirements are allowed to drive buses carrying out organized transportation of a group of children:

having at least one year of experience as a driver of a vehicle of category "D" as of the date of commencement of the organized transportation of a group of children from the last year and one month;

who have not committed administrative offenses in the field of traffic, for which an administrative penalty is provided in the form of deprivation of the right to drive a vehicle or administrative arrest, during the last year;

who have passed a pre-trip briefing on the safety of transporting children in accordance with the rules for ensuring the safety of transportation of passengers and goods by road and urban surface electric transport, approved by the Ministry of Transport of the Russian Federation;

who have passed a pre-trip medical examination in accordance with the procedure established by the Ministry of Health of the Russian Federation.

9. The inclusion of children under the age of 7 years in the group of children for organized transportation by buses when they are on the way according to the traffic schedule for more than 4 hours is not allowed.

10. Filing a notice of organized transportation of a group of children to the State traffic inspectorate unit if the organized transportation of a group of children is carried out by one or two buses, or applications for escorting vehicles by a patrol car (patrol cars) of the State traffic inspectorate unit if the specified transportation is carried out as part of not less than 3 buses, in accordance with the procedure established by the Ministry of Internal Affairs of the Russian Federation, are provided by the head or official of the organization responsible for ensuring road safety, and in the case of organized transportation of a group of children under a charter agreement:

charterer or charterer (by mutual agreement) - if the charterer is an authorized representative of a legal entity or an individual entrepreneur (its authorized representative);

Submission of a notification about the organized transportation of a group of children to the traffic police department is carried out no later than 48 hours before the start of transportation - in intercity traffic, no later than 24 hours before the start of transportation - in urban and suburban traffic.

Notification of organized transportation of a group of children may be submitted in respect of several planned organized transportation of a group of children along the same route, indicating the dates and times of such transportation.

When submitting a notification or an application specified in paragraph one of this paragraph, it is allowed to provide information only about the number of such participants in the transportation with the execution and transfer to the driver of the relevant list (lists) before the start of the organized transportation of a group of children.

11. At night (from 11 p.m. to 6 a.m.), organized transportation of a group of children to and from railway stations, airports, completion of an organized transportation of a group of children (delivery to the final destination determined by the traffic schedule, or to the place of overnight stay) is allowed in case of unplanned deviation from the traffic schedule (in case of a delay on the way), as well as organized transportation of a group of children, carried out on the basis of legal acts of the highest executive bodies of state power of the constituent entities of the Russian Federation. In this case, after 23 hours, the distance of transportation should not exceed 100 kilometers.

12. In case of organized transportation of a group of children in long-distance traffic by an organized transport column for more than 12 hours according to the traffic schedule, the head or official responsible for ensuring road safety, organization, and in case of organized transportation of a group of children under a chartering agreement - a charterer or charterer (according to mutual agreement) ensures that such a group of children is accompanied by a medical worker who has a copy of a license to carry out medical activities or a copy of an agreement with a medical organization or an individual entrepreneur that has the appropriate license.

Organized transportation of a group of children in the case specified in the first paragraph of this paragraph, without a medical worker is not allowed.

13. In the event of an unfavorable change in road conditions (traffic restriction, the appearance of temporary obstacles, etc.) and (or) other circumstances that entail a change in the departure time, the head or official responsible for ensuring road safety, organizations, and in the case of organized transportation of a group of children under a charter agreement - the charterer or charterer (by mutual agreement) ensures that measures are taken to timely notify the parents (legal representatives) of accompanying children, a medical worker (if there is a medical escort) and the relevant department of the State traffic inspectorate (when accompanied by a car (cars) of the traffic police department).

14. The head or official responsible for ensuring road safety, organization, and in the case of organized transportation of a group of children under a chartering agreement - the charterer shall ensure the appointment to each bus transporting children, accompanying, who accompany children during transportation to their destination.

The number of accompanying persons per 1 bus is assigned based on their location at each bus door intended for boarding (disembarking) passengers, while one of the accompanying persons is responsible for the organized transportation of a group of children on the corresponding bus and coordinates the actions of the driver (drivers) and other accompanying persons in the specified bus.

The appointed attendant is obliged to make sure that the children are fastened with seat belts before starting the bus, control their use of seat belts along the route, ensure order in the cabin, preventing children from getting up from their seats and moving them around the cabin while driving.

The appointed escort is also obliged to fulfill the requirements of the head of the organization or the individual entrepreneur - the charterer, brought to the attention of the escort during the briefing with him before the organized transportation of a group of children.

Organized transportation of a group of children without designated companions is not allowed.

15. If 2 or more buses are used for the organized transportation of a group of children, the head or official responsible for ensuring road safety, organization, and in the case of organized transportation of a group of children under a charter agreement, the charterer shall appoint a senior responsible for the organized transportation of a group of children and coordinating the actions of drivers and those responsible for buses carrying out such transportation.

The numbering of buses during movement is assigned by the head or official responsible for ensuring road safety, the organization, and in the case of organized transportation of a group of children under a charter agreement - by the charterer and transferred to the charterer to prepare a list of children.

When transporting by two or more buses, each driver is given information about the numbering of the bus during movement.

16. Organized transportation of a group of children must be carried out using seat belts.

17. If children are on the way according to the traffic schedule for more than 3 hours in each bus, the head or official responsible for ensuring road safety, organizations, and in the case of organized transportation of a group of children under a charter agreement - a charterer or charterer (by mutual agreement) ensures the availability of sets of food products (dry rations, bottled water) from the range established by the Federal Service for Supervision of Consumer Rights Protection and Human Welfare or its territorial office.

18. In the case of organized transportation of a group of children, it is forbidden to allow on the bus and (or) carry in it persons not included in the lists provided for in subparagraph "e" of paragraph 4 of these Rules. This prohibition does not apply to cases established by federal laws.

In case of non-appearance of the passengers specified in paragraphs two and five of subparagraph "e" of paragraph 4 of these Rules, their data shall be deleted from the list.

The rules for the transport of children on the bus have been developed to ensure maximum safety for underage passengers during organized trips. Special regulations stipulating the rules for transporting children on a bus are approved by law. There are specific requirements for the driver, vehicle and escort.

When and who approved the rules

The Ministry of Transport of the Russian Federation has developed rules for the organized transportation of groups of children. By the Decree of the Government of December 17, 2013 No. 1177, the document was approved.

The term "bus transportation of children" means:

  • Any transportation of minors, in the amount of 8 people or more.
  • Transportation by non-route vehicles.
  • Transportation of groups of children without their representatives (parents, adoptive parents, guardians).

An exception may be made if the representative is:

  • Medical worker, and his presence is mandatory for transportation.
  • Accompanying children's team.

Transportation under parental supervision

If transportation of children is carried out in the presence of their parents, adoptive parents or guardians who are not escorts of the group, the rules for organized transportation of children by buses do not apply to it.

Organized transportation of children

Transportation rules mean:

  • Escort by representatives of the traffic police of buses with minors.
  • Compliance of the driver with the requirements of the rules.
  • Preparation of a set of documents for transportation.
  • Compliance with requirements for accompanying persons.
  • Compliance with the rules for boarding / disembarking passengers in the vehicle.

Accompanying representatives of the traffic police

Buses with children are accompanied by law enforcement officers only if they move in a convoy of three or more vehicles.

When transporting children, it is necessary to obtain a permit for the transport of children from an authorized representative of the motor vehicle inspection. The original document is with the driver. At the first request of a traffic police officer, it must be provided.

Keep the original permits for 3 years from the date of transportation.

The organizers of the trip must submit a written application for escort to the regional department of the State Traffic Inspectorate no later than two days before the planned trip. The document must include:

  • The time for which support is required.
  • Number of children transported.
  • Name of the accompanying person.
  • Travel route.
  • Description of each bus with the obligatory indication of the license plate, full name of the driver and the registration data of his driver's license.

A response is drawn up in writing and sent to the applicant.

If children are transported by one or two buses, a notification about the upcoming trip is also sent to the traffic police department. The document must indicate:

  • Information about the company that organizes the transportation.
  • Date of transport.
  • Route with start and end points.
  • Number of children transported, by age.
  • The brand of the bus and its state number.
  • Name of accompanying person.

The document must contain a notification from the traffic police that they are aware and do not interfere with the transportation of children. A notice or a copy of the application with the marks of the traffic police must always be with the bus driver.

We draw up documents

When arranging transportation, it is necessary to prepare the following documentation:

  • Contract of carriage signed by the customer and the transport company.
  • An agreement with a medical worker to accompany a group of children (if the movement of the column lasts more than 12 hours).
  • Copy of permits for transportation of children.
  • A copy of the application for escort or notification from the traffic police.
  • List of accompanying persons with full name, passport details and phone numbers.
  • List of transported children.
  • List of food items on the bus.
  • Information about drivers (name, driver's license numbers, contacts).
  • Boarding document showing the seat for each child.

Who draws up the boarding document

  • Travel organizer.
  • Representative of the carrier (if such a clause is specified in the contract).
  • Medical worker (the document takes into account the individual characteristics of each passenger).
  • Escort.

When indicating the route of travel, it is necessary to note:

  • Travel schedule with the designation of the time of movement.
  • Places of planned stops for rest, food and excursions (indicating organizations, hotels).
  • Dates and times of stops to meet the physiological needs of passengers.

Vehicle and driver requirements

Drivers will be allowed to transport children if:

  • They have a driver's license with an open category D.
  • Bus driving experience is at least 1 year out of the last 3 years.
  • During the last year they did not commit administrative offenses, they were not deprived of their rights.
  • They have undergone a mandatory briefing on the transportation of children.
  • Received medical clearance for the flight.

Vehicle Requirements

The new rules for transporting children by school bus, in terms of transport for transporting children, will come into force on 01/01/2017. They stipulate:

  • Mandatory presence of a technical coupon or diagnostic card confirming the vehicle's serviceability.
  • A bus for transporting children must be no older than 10 years from the date of issue.
  • Each vehicle must be equipped with a tachograph that monitors the speed of the vehicle, sleep and rest of the driver.
  • There must be an installed satellite navigation system Glonass, to be able to determine the location of the bus at any time of the day.

Accompanying children

A group of children must be accompanied by an adult. Their responsibilities include:

  • Control the route and coordinate the movement of the bus in case of unforeseen situations.
  • Monitor the diet, behavior and health of children.

The number of adult escorts cannot be less than the number of doors on the bus. During the journey, there must be one escort at each door. If there are more adults, one chief is appointed among them, who coordinates the work of the rest of the escorts.

Who can be allowed on the bus

The group is formed from children of different ages. For kids under 7 years old, there is a restriction - they can be on the road for no longer than 4 hours. Otherwise, transportation of minors is prohibited.

Children who were previously included in the list by the leader will be allowed on the bus. In this case, before the start of the bus movement, the list can be changed by the head unilaterally. This means that the team leader or trip organizer can change the list without notifying the carrier.

The published material on the transportation of organized groups of children by road was prepared on the basis of the following legislative acts:

  • Decree of the Government of the Russian Federation No. 1177 of December 17, 2013 was adopted "On approval of the Rules for the organized transportation of a group of children by buses" ,

Let's start by defining what is"ORGANIZED TRANSPORTATION FOR A GROUP OF CHILDREN"?

Are there any age restrictions for children being transported?

Currently, for the transportation of an organized group of children (within a settlement, to another region), several documents are required in accordance with the current Rules of the SDA and Government Decree No. 1177 (including subsequent changes and additions to it).

    who have passed a pre-trip medical examination in accordance with the procedure established by the Ministry of Health of the Russian Federation.

Innovations affect the features of the transportation of groups of children. First of all, this information is intended for the staff of child care facilities, as well as drivers of travel companies involved in the transportation of minor children.

The concept of organized transportation of a group of children

Since July 10, 2015, the concept of "Organized transportation of a group of children" has been changed in the traffic rules:

"Organized transportation of a group of children" - organized transportation of eight or more children in a bus that is not a shuttle vehicle.

"Organized transportation of a group of children" - transportation in a bus, not related to a shuttle vehicle, of a group of children of 8 or more people, carried out without their legal representatives, unless the legal representative (s) is (are) appointed (and) accompanying person(s) or designated healthcare professional.

As before, organized transportation has the following features:

  • the children are on the bus;
  • the bus is not public transport;
  • the number of children is 8 or more.

A new sign of organized transportation. It is carried out without legal representatives of children. Let me remind you that the legal representatives of the child are parents, adoptive parents, trustees or guardians.

So if children and their parents are traveling on a bus, for example, a sightseeing bus, this is not an organized transportation of children and the rules of organized transportation do not apply to this case.

However, there are situations when, even with the presence of legal representatives, the transportation is organized. For example, there are 8 children on the bus. The parents of one of the children act as an accompanying person. Transportation in this case is organized and requires compliance with the rules.

Accompanying children by traffic police car

First of all, the changes affected the list of documents required for the organized transportation of a group of children:

c) a decision to appoint an escort for buses by a car (cars) of a subdivision of the State Inspectorate for Road Safety of a territorial body of the Ministry of Internal Affairs of the Russian Federation (hereinafter referred to as the subdivision of the State Traffic Inspectorate) or a notification of a negative decision based on the results of consideration of an application for such escort;

c) a copy of the decision to appoint the escort of buses by a car (cars) of a subdivision of the State Inspectorate for Road Safety of a territorial body of the Ministry of Internal Affairs of the Russian Federation (hereinafter referred to as the subdivision of the State Traffic Inspectorate) or a copy of the notification of the organized transportation of a group of children;

Until July 10, 2015, the original decision on the appointment of an escort or the original refusal of escort was required for the transportation of children. Starting from July 10, a copy of the decision on the appointment of escort or a copy of the traffic police notification is required.

Consider the related clause of the carriage rules:

10. The head or official responsible for ensuring road safety, the organization, and in the case of organized transportation of a group of children under a charter agreement, the charterer or charterer (by mutual agreement) ensures that an application is submitted in the prescribed manner for escorting buses by cars of the State traffic inspectorate unit.

Submission of a notice of organized transportation of a group of children to the subdivision of the State traffic inspectorate is carried out no later than 2 days before the day the transportation begins.

Until July 10, 2015, the head of the group had to submit an application to the traffic police for escorting buses with traffic police cars.

Starting July 10 application for support applied only if the transportation is carried out by three or more buses. In this case, the traffic police sends an escort car.

If the children are traveling in one or two buses, then another document is submitted to the traffic police - notice of organized transportation of a group of children. In this case, the escort car is not allocated.

Documents are submitted no later than 2 days before the start of the trip.

Attention! The deadline for filing a notification with the traffic police has been changed from October 1, 2019. It is 24 hours for urban and suburban travel and 48 hours for intercity travel. This issue is discussed in .

In any case, the team leader must carry either a copy of the escort request or a copy of the organized transport notice.

Documents for organized transportation of children

Starting July 10, 2015, when transporting children, a list of food kits must be available. Previously, such a list was required only if the estimated travel time was more than 3 hours.

Requirements for drivers carrying children

8. Drivers who have continuous experience as a driver of a vehicle of category "D" for at least 1 year and have not been subjected to administrative punishment in the form of deprivation of the right to drive a vehicle or administrative arrest for committing an administrative offense in the field of traffic.

  • who have passed a pre-trip briefing on the safety of transporting children in accordance with the rules for ensuring the safety of transportation of passengers and goods by road and urban surface electric transport, approved by the Ministry of Transport of the Russian Federation;
  • who have passed a pre-trip medical examination in accordance with the procedure established by the Ministry of Health of the Russian Federation.

As before, drivers who carry out organized transportation of children should not have penalties in the form of deprivation of their rights or administrative arrest during the last year.

Until 10 July 2015, drivers also had to have uninterrupted driving experience as a category D driver within the last year. This requirement becomes more loyal to drivers. Starting from July 10, it is enough to have one year of experience out of the last three years.

For example, the following situation could have happened earlier. A person has been working as a category D driver all his life. However, half a year ago he moved to a new job (also a driver). During the change of workplace, the experience was interrupted for 1 day. Until July 10, 2015, such a driver was not allowed to organize transportation of children. After July 10, there is no such restriction.

Situations in which a health worker is required

12. In case of organized transportation of a group of children in intercity traffic by an organized transport column for more than 3 hours according to the traffic schedule, the head or official responsible for ensuring road safety, organization, and in case of organized transportation of a group of children under a chartering agreement - a charterer or charterer (according to mutual agreement) ensures that such a group of children is accompanied by a medical worker.

12. In case of organized transportation of a group of children in long-distance traffic by an organized transport convoy for more than 12 hours according to the traffic schedule, the head or official responsible for ensuring road safety, the organization, and in the case of organized transportation of a group of children under a charter agreement, the charterer or charterer (by mutual agreement) shall ensure that such a group of children is accompanied by a medical worker.

Previously, a medical worker was required for transportation, the estimated duration of which exceeds 3 hours. Starting from July 10, a doctor is needed when transporting children only on trips whose duration is exceeds 12 hours.

This requirement has made travel arrangements easier. Many day trips for children can now be dispensed with without a medical professional.

Admission to the bus transporting children

A new paragraph has been added to the rules for organized transportation of children:

18. In the case of organized transportation of a group of children by buses, it is prohibited to allow on the bus and (or) carry in it persons not included in the lists provided for in subparagraph "e" of paragraph 4 of these Rules, except for the appointed medical worker. This prohibition does not apply to cases established by federal laws.

Only persons included in the list of accompanying persons or the list of children can be allowed on the bus.

For example, parents of one of the children not included in the preliminary list will not be allowed on the bus. Also, additional children cannot be placed on the bus.

However, the organizer always has the opportunity to add to the list of people who need to be taken on a trip.
