  1. General provisions

1.1. These Regulations have been developed in accordance with the Law “On Education in Russian Federation» dated December 29, 2012 N 273-FZ.

Certification commission of the municipal budget preschool educational institution“Primorsky Kindergarten” (hereinafter - DOU) in its work is guided by the order of the Ministry of Health and Social Development of the Russian Federation dated August 26, 2010 No. 761n “On approval of the Unified qualification directory positions of managers, specialists and employees, section “Qualification characteristics of positions of educational workers”, the Procedure for certification of teaching staff of state and municipal educational institutions, regulatory legal acts of preschool educational institutions regulating the certification of teaching staff (hereinafter referred to as certification), these Regulations.

1.2.The main principles of the work of the certification commission of preschool educational institutions are collegiality, competence, objectivity, transparency, independence, compliance with professional ethics, openness, ensuring an objective attitude towards teaching staff, and inadmissibility of discrimination during certification.

1.3. The certification commission of the preschool educational institution is formed to conduct certification in order to establish compliance with the position of teaching staff.

1.4. The decision of the certification commission is valid for five years from the date of the decision.

  1. Structure and composition of the preschool education certification commission

2.1. The certification commission has the following structure:

  • chairman of the certification commission;
  • vice-chairman;
  • secretary;
  • members of the commission, including a representative of the collegial governing body of the organization and a representative of the parent community.

2.2. The certification commission is formed from among the teaching staff of the preschool educational institution. The head of the organization cannot be the chairman of the certification commission.

2.3. The composition of the certification commission is formed in such a way as to exclude the possibility of a conflict of interest that could affect the decisions made by the certification commission.

2.4. The size of the certification commission is at least 5 people.

2.5. The personal composition of the certification commission is approved by order of the head of the preschool educational institution.

2.6. The powers of individual members of the certification commission can be terminated early by order of the head of the preschool educational institution on the following grounds:

  • inability to perform duties due to health reasons;
  • dismissal of a member of the certification commission;
  • failure to perform or improper performance of the duties of a member of the certification commission.

2.7.Chairman of the certification commission:

  • manages the activities of the certification commission;
  • conducts meetings of the certification commission;
  • distributes responsibilities among members of the certification commission;
  • signs protocols, certification sheets;
  • controls the storage and recording of documents on certification of teaching staff;

2.8. The chairman of the certification commission has a deputy.

Deputy Certification Commission:

  • acts as chairman in his absence (vacation, business trip, etc.);
  • participates in the work of the certification commission;
  • provides consultations for teaching staff;
  • considers appeals and complaints from teaching staff related to issues of their certification.

2.9. Secretary of the certification commission:

  • reports directly to the chairman of the certification commission;
  • carries out registration of documents, certification cases;
  • maintains and draws up minutes of meetings of the certification commission;
  • ensures the preparation of certification sheets for teaching staff;
  • participates in resolving disputes and conflict situations related to the certification of teaching staff;
  • signs minutes of meetings of the certification commission, certification sheets.

2.10. Members of the certification commission:

  • participate in the work of the certification commission;
  • ensure the implementation of organizational functions for the certification of teaching staff of preschool educational institutions.
  • Regulations of work of the certification commission of the preschool educational institution

3.1. The decision to conduct certification of teaching staff is made by the employer. The employer issues a corresponding administrative act, which includes a list of employees subject to certification, a certification schedule and brings it to the attention of each person being certified against signature at least a month before the start of certification.

3.2. Timing of certification for each teaching worker are established by the certification commission individually in accordance with the schedule. When drawing up the schedule, the validity periods of previously established qualification categories are taken into account.

3.3. A meeting of the certification commission is considered valid if at least two thirds of its members are present.

3.4. The teaching staff must be personally present during his certification at a meeting of the certification commission. If it is impossible for an employee to be present on the day of certification at a meeting of the certification commission for valid reasons (illness, business trip, etc.), appropriate changes are made to the certification schedule.

If a teacher fails to appear at a meeting of the certification commission without a valid reason, the commission has the right to conduct certification in his absence.

3.5. The certification commission considers the information about the teaching worker contained in the employer’s submission, the statement of the person being certified with the appropriate justification in case of disagreement with the employer’s representation, and also assesses the compliance of the teaching worker with the qualification requirements for the position held.

Members of the certification commission, if necessary, have the right to ask the teaching staff questions related to the performance of official duties.

The secretary of the certification commission keeps minutes of the meeting of the certification commission (hereinafter referred to as the minutes), in which he records its decisions and voting results. The minutes are signed by the chairman, deputy chairman, secretary and members of the certification commission present at the meeting and are kept by the employer.

3.6. Based on the results of the certification, the certification commission makes one of the following decisions:

  • corresponds to the position held (position is indicated);
  • corresponds to the position held (position is indicated), provided vocational training or advanced training;
  • does not correspond to the position held (the position is indicated).

3.7. The decision by the certification commission is made in the absence of the teacher being certified by open voting by a majority vote of the members of the certification commission present at the meeting. If there is an equal number of votes among members of the certification commission, it is considered that the employee has passed the certification. When undergoing certification, an employee who is a member of the certification commission does not participate in voting on his candidacy.

3.8. The results of the certification of an employee directly present at the meeting of the certification commission are communicated to him after the final vote.

3.9. The teaching staff gets acquainted with the certification results, documented in the protocol, against signature.

3.10. The certification commission considers requests from the head of the preschool educational institution to postpone the date of qualification tests of a teaching worker for good reason as part of certification in order to confirm the compliance of the teaching worker with the position held and makes a decision to change the certification period.

3.11. The teaching staff has the right to appeal the results of certification to the court in accordance with the legislation of the Russian Federation.

3.12. The certification commission of an educational organization, upon the recommendation of the employer, has the right to make recommendations on the possibility of hiring for positions of teaching staff persons who do not have special training or work experience established in the “Qualification Requirements” section of the qualification characteristics, but with sufficient practical experience and competence, as established in paragraph 9 “ General provisions» section "Qualification characteristics of positions of educators" of the Unified Qualification Directory of Positions of Managers, Specialists and Employees, approved by Order of the Ministry of Health and Social Development of the Russian Federation dated August 26, 2010 No. 761n, registered with the Ministry of Justice of the Russian Federation on October 6, 2010, registration No. 18638.

  1. Implementation of decisions of the preschool education certification commission

4.1. The decision of the certification commission is documented in a protocol, which comes into force from the date of signing by the chairman, deputy chairman, secretary and members of the certification commission who took part in the voting, and is entered into the certification sheet of the teaching worker.

4.2. The decision of the certification commission is entered into the certification sheet, which is signed by the chairman, deputy chairman, secretary of the certification commission, and members of the commission.

4.3. If necessary, the certification commission enters into the employee’s certification sheet recommendations for improving the employee’s professional activities, the need to improve his qualifications, indicating his specialization, and other recommendations. If the certification sheet contains the specified recommendations, the head of the preschool educational institution, no later than one year from the date of certification of the teaching worker, submits to the certification commission information on the implementation of the recommendations of the certification commission on improving the professional activity of the teaching worker.

4.4. The decision of the certification commission on the results of certification of employees is approved by order of the head of the preschool educational institution.

4.5. The teaching staff is introduced to the certification sheet and the order of the head of the preschool educational institution no later than 30 calendar days from the date of the decision of the certification commission and the adoption of decisions in accordance with the Labor Code of the Russian Federation. The second copy of the certification sheet is stored in the personal file of the teacher.

  1. Responsibility of the certification commission of the preschool educational institution

5.1. The certification commission is responsible for:

  • making an informed decision based on the results of certification of the activities of a teaching worker in accordance with the position held;
  • thorough study and analysis of all submitted documentation for certification;
  • strict compliance with the procedure for certification of teaching staff;
  • creating favorable conditions for teaching staff undergoing certification;
  • strict adherence to the confidentiality of the information received.
  • Office work

The documentation of the certification commission includes:

  • orders of the head of the preschool educational institution on the composition of the certification commission;
  • schedules of meetings of the certification commission;
  • minutes of meetings of the certification commission;
  • correspondence regarding certification;
  • statements of disagreement with the decision of the certification commission, documents on their consideration;
  • reports on certification of teaching staff.
  • Consideration of labor disputes related to certification

7.1. If, based on the results of certification, a teaching worker is recognized as unsuitable for the position held due to insufficient qualifications, the employment contract with him may be terminated in accordance with clause 3 of part 1 of Article 81 of the Labor Code of the Russian Federation.

7.2. Labor disputes related to certification are considered in accordance with the current legislation on the procedure for resolving labor disputes.

1. General Provisions

1.2. The main principles of certification are collegiality, transparency, openness, ensuring an objective attitude towards teaching staff, and inadmissibility of discrimination during certification.

1.3. Certificationteaching staffCompliance with the position held is carried out once every five years and is mandatory. Refusal to undergo certification is a violation of labor discipline.

1.4. The purpose of certificationisconfirmation of the compliance of teaching staffpositions they occupy based on an assessment of their professional activities.

1.5. The main objectives of certification of teaching staff are:

    objective assessment of the activities of teaching staff and determination of suitability for the position held;

    identifying prospects for using the potential professional capabilities of teaching staff;

    taking into account the requirements of federal state educational standards for personnel conditions for the implementation of educational programs when forming the personnel of an educational institution;

    stimulating targeted, continuous professional growth and personal development of teaching staff.

2. Composition of the certification commission and work procedure

2.1. The commission is formed from among employees of the educational institution,primary trade union organization, self-government bodies of an educational institution.The personnel composition is formed in such a way as to exclude the possibility of a conflict of interest, which could affect the decisions made by the certification commission, and is approved by the employer’s administrative act.

2.2. At the organizational meeting of the commission, the chairman, deputy chairman and secretary of the commission are elected.Chairman of the certification commission:

Organizes the work of the certification commission;

Distributes responsibilities between members of the certification commission;

Conducts meetings of the certification commission;

Decides to hold unscheduled meetings of the certification commission.

2.3. In the absence of the chairman, his duties are performed by the deputy chairman.

2.4. The organization of work on preparing meetings, maintaining and drawing up minutes of meetings is carried out by the secretary of the certification commission.

2.5. Certifying commission:

Makes a decision on the suitability or non-compliance of the person being certified for the position held based on the test results and demonstration of an organized type of activity with children, followed by self-analysis.

2.6. The meeting of the certification commission is held as certification activities are carried out.

3. Certification procedure

3.1. The basis for certification of compliance with the position of a teaching worker is an order from the head of the preschool educational institution.

3.2. Information about the date, place and time of certification is brought in writing by the head of the preschool educational institution to the attention of the teaching worker subject to certification no later than 30 calendar days before the day of their certification according to the schedule.

3.3. To carry out certification for each teaching worker, the head submits to the certification commission of the educational institution a submission for the person being certified, which contains the following information about the teaching worker:

    Full Name;

    Name of the position as of the date of certification;

    Date of conclusion of the employment contract for this position;

    Level of education and (or) qualifications in specialty or area of ​​training;

    Information about obtaining additional professional education in the profile of teaching activity;

    Results of previous certifications (if any);

    A motivated, comprehensive and objective assessment of professional, business qualities, and the results of the professional activities of a teacher in fulfilling the labor duties assigned to him by the employment contract.

3.4. The head acquaints teaching staff with the submission against signature no later than 30 calendar days before the day of certification. After reviewing the submission, the teaching worker may, if desired, submit to the organization’s certification commission additional information characterizing his professional activities for the period from the date of the previous certification (if primary certification– from the date of entry into work).

3.5. During certification, teaching staff undergo qualification tests, which are carried out in the formshowing an organized type of activity with children followed by self-analysis.

3.6. If a teacher is absent on the day of certification for good reasons, his certification is postponed to another date, and appropriate changes are made to the certification schedule, about which the manager informs the employee against signature at least 30 calendar days before new date carrying out its certification.

3.7. Based on the results of the certification, the commission makes one of the following decisions:

corresponds to the position held (the position of the employee is indicated);

does not correspond to the position held (the employee’s position is indicated).

3.8. The decision is made by the certification commission of the organization in the absence of the certified teacher, by open voting by a majority vote of the members of the certification commission of the organization.

When undergoing certification, a teacher who is a member of the organization’s certification commission does not participate in voting on his candidacy.

The decision of the commission is documented in a protocol, which is signed by the chairman, deputy chairman, secretary and members of the commission who took part in the voting.

3.9. The commission's decision is entered into the teacher's certification sheet.

If necessary, the commission enters into the certification sheet of the teaching worker recommendations for improving the professional activities of the teaching worker, the need to improve his qualifications, indicating his specialization, and other recommendations. These recommendations are used in further work with the teacher.

3.10. The decision of the certification commission on the results of certification of a teaching worker is approved by order of the head of the preschool educational institution.

3.11. The head of the preschool education institution is obliged to familiarize the employee with the certification sheet and the order on the certification results against signature.

3.12. The certification sheet and an extract from the order on the certification results are stored in the personal file of the teacher.

3.13. The teacher has the right to appeal the result of certification in the manner prescribed by the legislation of the Russian Federation.

3.14. The following teaching staff do not undergo certification to confirm compliance with the position held:

a) teaching staff who have qualification category;

b) those who have worked in their position for less than two years in the organization in which the certification is carried out;

c) pregnant women;

d) women on maternity leave;

e) persons on parental leave until the child reaches the age of three;

f) absent from work for more than four months in a row due to illness.

Certification of teaching staff provided for in subparagraphs “d” and “e” of this paragraph is possible no earlier than two years after their return from the specified vacations.

Certification of teaching staff provided for in subparagraph “e” of this paragraph is possible no earlier than one year after their return to work.

4.Rights of the certification commission

Members of the certification commission have the right:

  • request the necessary information within the limits of competence;
  • determine the algorithm of activity of the certification commission;
  • determine the frequency of meetings of the certification commission.

5.Regulations of the work of the certification commission of the preschool educational institution

5.1. Meetings of the certification commission are held in accordance with the schedule approved by the order of the head and posted on the official website of the MK preschool educational institution Pavlovsk kindergarten No. 5.

5.2. A meeting of the organization’s certification commission is considered valid if at least two-thirds of the total number of members of the organization’s certification commission are present.

5.3. If a teaching worker is absent on the day of certification at a meeting of the organization’s certification commission for good reasons, his certification is postponed to another date, and appropriate changes are made to the certification schedule, about which the employer informs the employee against signature at least 30 calendar days before new date for its certification.

If a teacher fails to appear at a meeting of the organization’s certification commission without a valid reason, the organization’s certification commission conducts certification in his absence.

5.4. The organization's certification commission reviews the submission and additional information provided by the teaching staff member himself, characterizing his professional activities (if submitted).

5.5. Based on the results of certification of a teaching employee, the certification commission of the organization makes one of the following decisions:

corresponds to the position held (the position of the teaching staff is indicated);

does not correspond to the position held (the position of a teaching worker is indicated).

5.6. The decision is made by the certification commission of the organization in the absence of the teacher being certified by an open vote by a majority vote of the members of the certification commission of the organization present at the meeting.

When undergoing certification, a teacher who is a member of the organization’s certification commission does not participate in voting on his candidacy.

5.7. In cases where at least half of the members of the organization’s certification commission present at the meeting voted for the decision on the employee’s suitability for the position held, the teaching employee is recognized as appropriate for the position held.

5.8. The results of the certification of a teacher directly present at a meeting of the organization’s certification commission are communicated to him after the voting results are summed up.

5.9. The results of certification of teaching staff are entered into a protocol signed by the chairman, deputy chairman, secretary and members of the organization’s certification commission present at the meeting, which is stored with submissions, additional information provided by the teaching staff themselves, characterizing their professional activities (if any), employer.

5.10. For a teaching worker who has passed the certification, no later than two working days from the date of its conduct, the secretary of the certification commission of the organization draws up an extract from the protocol containing information about the surname, first name, patronymic (if any) of the person being certified, the name of his position, the date of the meeting of the certification commission of the organization, the results voting on the decision made by the certification commission of the organization. The employer provides the teaching staff with an extract from the protocol against signature within three working days after its preparation. An extract from the protocol is kept in the personal file of the teacher.

5.11. The results of certification in order to confirm the compliance of teaching staff with the positions they occupy based on an assessment of their professional activities, the teaching staff has the right to appeal in accordance with the legislation of the Russian Federation.

5.12. Certification commissions of organizations give recommendations to the employer on the possibility of appointing to the appropriate positions of teaching staff persons who do not have special training or work experience established in the section "Qualification Requirements" of the section "Qualification Characteristics of Positions of Education Workers" of the Unified Qualification Directory of Positions of Managers, Specialists and Employees and (or) professional standards, but with sufficient practical experience and competence, performing their job responsibilities efficiently and in full.

6. Responsibility of the certification commission of the preschool educational institution

The certification commission is responsible for:

  • making an informed decision based on the results of certification of the activities of a teaching worker in accordance with the position held;
  • thorough study and analysis of all submitted documentation for certification;
  • strict compliance with the procedure for certification of teaching staff;
  • creating favorable conditions for teaching staff undergoing certification;
  • strict adherence to the confidentiality of the information received.

7. Office work

The documentation of the certification commission includes:

  • orders of the head on the composition of the certification commission;
  • schedules of meetings of the certification commission;
  • minutes of meetings of the certification commission;
  • correspondence regarding certification;
  • statements of disagreement with the decision of the certification commission, documents on their consideration;
  • reports on certification of teaching staff.

8. Consideration of labor disputes related to certification

8.1. If, based on the results of certification, a teaching worker is recognized as unsuitable for the position held due to insufficient qualifications, the employment contract with him may be terminated in accordance with paragraph 3 of part 1 of Article 81 of the Labor Code of the Russian Federation.

8.2. Labor disputes related to certification are considered in accordance with the current legislation on the procedure for considering labor disputes.

1.3. The main objectives of certification are:

Stimulating targeted, continuous improvement of the level of professional competence of teaching staff of preschool educational institutions;

Providing teaching staff of preschool educational institutions with the opportunity to increase their wages;

1.4. The main principles of certification are:

Voluntary certification for teaching staff;

Openness and collegiality, ensuring an objective, humane and friendly attitude towards certified teaching staff;

1.5. The regulatory basis for certification is:

Law of the Russian Federation “On Education” No. 273-FZ;

This Regulation;

1.6. Compliance with the position held by teaching staff is assigned for a period of five years.

2. Organization and timing of certification.

2.1. The basis for the certification of teaching staff for compliance with the position held, the hiring of an employee who does not have teaching experience and education to the position of educator is the personal application of the employee.

No other documents are required. An application in the prescribed form is submitted by the employee to the certification commission of the preschool educational institution at any time.

2.2. Certification is carried out within 1 month from the date of application. The timing of certification for each teaching employee (hereinafter referred to as the certified one) is set individually in accordance with the schedule, of which the employee is notified no later than two weeks before the start of certification. The duration of certification for each certified person should not exceed two months from the beginning of its completion until a decision is made.

2.3. Certification of teaching staff (hereinafter referred to as workers) is carried out on the basis of an expert assessment of their qualifications, professional competence and effectiveness of teaching activities (hereinafter referred to as examination).

2.4. The examination is a comprehensive assessment of the employee’s activities based on the submitted materials and documents collected in the individual folder of the person being certified (portfolio).

2.5. The certified person has the right to choose a specific form of procedure: both in his presence (the “interview” form based on portfolio materials) and without his participation (the “observation of the teacher’s activities” form).

2.6. The portfolio accumulates documented results that confirm the competence and efficiency of the employee’s work, his individual achievements acquired over the previous 2 years of work, in various types of activities: educational, creative, social, communicative.

2.7. The manager is responsible for the accuracy of the documents presented in the portfolio of the certified person.

2.8. The examination is carried out on the basis of indicators developed in accordance with job characteristics and indicated in the assessment sheets for the professional competence and performance of the person being certified.

2.9. Pedagogical employees of preschool educational institutions can undergo certification for a higher qualification category before the expiration of the validity period for the position held.

2.10. Employees performing teaching work in preschool educational institutions on a part-time basis have the right to undergo certification in accordance with these Regulations.

2.11. Employees who do not have pedagogical education and experience are allowed to work if they have the appropriate qualifications.

3. The certification commission of the preschool educational institution, its composition and work regulations.

3.1. The certification commission of the preschool educational institution conducts an expert assessment of the teacher’s activities.

3.2. The date and place of the examination are informed to the employee by the certification commission no later than two weeks before it is carried out.

3.3. Based on the results of the examination, group members fill out sheets assessing the level of professional competence and performance of the certified person.

3.4. Based on the results obtained, the manager prepares an expert opinion, which is issued within 5 days to the certified person for review.

3.5. The certification commission of the preschool educational institution, on the basis of an expert opinion on assessing the level of professional competence and performance of the employee, makes a decision on the suitability/inconsistency of the employee for the position held.

3.6. The decision of the preschool educational institution certification commission is entered into the certification sheet, which is signed by the chairman of the preschool educational institution certification commission and its secretary. The certification sheet is drawn up in two copies, one of which is kept in the employee’s personal file, the other is handed over to him.

4. Competence of the certification commission of the preschool educational institution.

4.1. The competence of the preschool education certification commission includes:

Receiving applications from teaching staff to participate in certification of suitability for the position held;

Timely informing preschool teaching staff about the timing, location, and qualification tests;

Prepares a conclusion based on expert assessment.

5.Implementation of decisions of the expert group and certification commission of the preschool educational institution.

5.1. The head of the educational institution, on the basis of the conclusion of the certification commission of the preschool education institution, issues an order within ten days to assign the employee compliance with the position held. The qualification category is assigned from the date of the conclusion of the certification commission. An entry is made on the certification sheet about the assignment of compliance to the position held, and the date and number of the order are indicated. The certification sheet is signed by the head of the educational institution and certified with a seal.

5.2. In case of recognition of pedagogical preschool employee If not appropriate for the position held, certification for the same or higher qualification category at the request of the employee may be carried out no earlier than one year from the date of the relevant decision by the certification commission in the manner and within the time limits established by these Regulations.
